We've Got This Thing!

 

There's this thing, this thing that tells us citizens what we can expect from our government and it's golden.

 

There's this thing, this thing that tells the government what they may not do, and it's golden.

 

There's this thing, a law. A law upon which all others must be predicated, and it's golden.

 

This thing tells us that we have a right to be secure against unreasonable searches, yet Representative Ugaste, an attorney who should know better, seems not to understand this. You see, he filed HB5129 Mental Health Danger Notice, compelling mental health professionals to violate their patients' trust by reporting them to local police. Illinois law already requires this violation of your rights; HB5129 makes it worse.

 

This thing also tells us we have a right to keep and bear arms, a right not predicated on completion of any training. No true right can require training or payment of fees. Yet Representative Benton's HB5254 Firearm Owners ID - Training would have the state require “hands-on firearm safety training” in order to obtain its permission to exercise this right. Yes, it's true that training is long standing tradition, a bonding between parent and child, grand-parent and grand-child. No, it is not true that there was ever an analogous law requiring training during the founding era, as stipulated in NYSRPA v Bruen.

 

Nor is there a founding tradition of requiring our ammunition to include identifying marks. We've spoken of the lack of historical tradition requiring serial numbers on guns. And, although it might have been that individual owners occasionally chose to put an identifying mark on their firearm for their own convenience, no thought was ever given during any period in US history to mark ammunition in a way that identifies the owner. Representative Buckner hopes we won't notice that with his HB5319 Microstamp – Enabled Pistol, he would establish an entirely new ownership requirement. He hopes no one will notice that it grossly violates the Supreme Court's guidance.

 

This golden thing we have, this Constitution of the United States, presents a choice.

 

Will health care providers comply with the privacy we have a right to expect. Will they ignore HB5129 if it becomes law?

 

Will gun owners comply with a training requirement, or will they simply go on with life unchanged, even without a FOID Card?

 

Will gun owners rush out to buy a fancy new microstamp enabled firearm, or will HB5319 create felons of folks who simply want to use, sell, transfer things that were legally purchased,

as guaranteed in the Constitution?

 

We don't claim to know the answers to these questions, and we certainly don't promote violating Illinois law. We can make some predictions, though. And, based on Illinois' experience with the Protect Illinois Communities Act, it's easy to predict that additional bridges might be a bit too far.
