As we contemplate the message this season brings to each of us, we are grateful for the many blessings bestowed upon us by the Creator spoken of in the US Constitution. Love, compassion, forgiveness being chief among these blessings yet, no less important, the freedoms enshrined in, and protected by, the Constitution. The Founders found inspiration in the Creator to craft a Bill of Rights meant to keep in check those they foresaw would seek to destroy our freedoms. In New York State Rifle & Pistol Association v Bruen, the US Supreme Court tells us that these protections today mean as much as, and the same as, they did at the time they were written. Anti-gun forces would like us to forget this but, to do so, would be to reject the gifts bestowed by the Creator. Over the past several months we've asked your help protecting our rights. Because those who oppose us respect nothing that is not of their own creation, today we must ask your help again. HB1305 Ins – Task Force On Firearm Ins, a bill introduced over one year ago by Bridge-Too-Far-Bob Morgan and recently amended, has been posted to the House Judiciary – Criminal Committee hearing on 4/2/2024. The bill would establish a task force to “review current and potential future insurance policy offerings for the safe and legal possession of firearms and offer policymaking recommendations related to the use of that insurance.” “Safe and legal possession of firearms” is legislative speak for requiring insurance as a prerequisite for gun ownership. “Use of that insurance” is legislative speak for transferring the cost associated with victim compensation programs to the private sector. If established, what will this task force find? Ask former Representative Ken Dunkin who, back in the 96th General Assembly, worked tirelessly on HB687 Firearm Owners ID – Insurance. Much to his chagrin, he found that > Though a few exceptions exist for legal self defense, liability insurance does not cover intentional acts. > Insurance does not cover illegal acts. > Insurance designed for concealed carry licensees, like any liability insurance, primarily provides a defense. It is not a financial bucket into which to dip the ladle of social equity. > Insurance companies are indifferent to their clients ownership of firearms. Most offer special coverage for firearms in the same way they offer special coverage for jewelry and furs. > Even knowing their clients own firearms, insurers do not now and will not voluntarily impose any storage or training requirements on those clients. > Though some might argue that a few jurisdictions had historical surety laws related to gun ownership, surety and insurance are fundamentally different products. > Surety laws that did exist were generally enacted well after the historic period that the Supreme Court recently instructs must be used for guidance. > An insurance or surety requirement will have a disproportionately negative effect on gun ownership by the less fortunate, people struggling to pay the rent who can't afford a homeowner or any other policy of insurance. > An insurance requirement will not make our cities safer. As explained in The Insurance Journal: “Wherever these proposals surface, insurers have been telling lawmakers that such approaches would not only violate basic insurance principles but also be unworkable. “Though well intentioned, such proposals misunderstand a fundamental principle of insurance—that it is designed to cover fortuitous, or accidental events; not intentional conduct. Property/casualty insurance does not and cannot cover intentional behavior such as criminal acts,” said Willem O. Rijksen, vice president of public affairs for the American Insurance Association. According to Jimi Grande, senior vice president of federal and political affairs for the National Association of Mutual Insurance Companies, gun liability insurance measures would neither deter violence nor help victims. “Liability coverage is designed to protect against accidental damages, most of which involving guns would be covered under a homeowner’s insurance policy. While some policies may provide coverage for liability stemming from the intentional use of a firearm for defensive purposes, no liability insurance product covers intentional acts of malicious violence, whether committed with a gun, a car, or any other instrument that is used as a weapon to deliberately harm people,” said Grande. “It is inconceivable that any insurer would offer such coverage, either as part of a homeowners or renters policy or on a stand-alone basis.”” Had this bill been properly assigned to the Insurance Committee, it would have suffered the same ridicule as Mr. Dunkin's HB687 did so many years ago. The Illinois Legislature should ask itself why it would waste its time and resources on the kind of nonsense proposed in HB1305. Join us in opposing this legislation now. File Witness Slips Now! I realize things usually would be proposed and go into a committee and then to the full chamber if it's going to advance, at least that's how I think it works. Thanks!
