Niles range lawsuit status?

Last year the Niles village trustees voted to allow construction of a gun store and range by the Sportsman's Club and Firearms Training Academy. There was an article in the Trib (http://www.chicagotribune.com/suburbs/park-ridge-niles/ct-niles-gun-range-met-20141017-story.html) which stated that a group calling itself People for a Safer Society had filed suit against the village with the goal of overturning the village's decision.

 

The attorney, Anthony S. Hind, and his law firm have links to press coverage on their FB page (https://www.facebook.com/centrallawgroupevanston?fref=nf), the most recent being 12/16/2014, so apparently it's still alive. However, I have not been able to find this lawsuit listed via the Cook County court docket search site and the Village offices have not returned calls concerning this matter. Has anyone here heard anything?

OK, so it's moving, but very, very, very slowly. It will be interesting to see how long the range has been open by the time the case is decided.

Lee Goodman is still at it. Iirc, that's Ellen Chiocca (sp?) next to him. I'd have to review the Niles story and interview that played on channel 2's 10pm news to be sure. She's a nut bag abusing her professional license as an Advanced Practice Nurse to make ridiculous claims such as PTSD after only a 20 second conversation.

She's a nut bag abusing her professional license as an Advanced Practice Nurse to make ridiculous claims such as PTSD after only a 20 second conversation.

Was that you that she accused of having PTSD, or another Illinois Carry member? And did you ever manage to contact her licensing agency to lodge a formal complaint?

It was me, and I sent a letter, but that was pretty much the end of that.

This is an interesting case study. Not to say that ALL mental health professionals share her attitude, but it really goes to show you the problems with trying to address the so-called "mental health gun issue". As long as people fear losing their rights if they seek help for a mental problem, then they won't bother getting treatment out of fear of losing their rights.

 

I'm surprised more people don't address this elephant in the room. People are always screaming and yelling that "we need stronger mental health reporting laws", but such things are unworkable as long as they pose a threat to the exercise of someone's constitutional rights. And as history has shown, people are more than willing to abuse the mental health reporting functions that are in place if they want to get back at someone (or out of a misguided attempt to help a "sick" person).

According to that article a ruling on a preliminary question which would have a major affect on the chances for success of this lawsuit is expected today (4/14/2015).

 

 

At issue in a ruling, expected Tuesday, Apr. 14, is whether the challenge to the special use permit would be “facial” or “as applied.”

 

In their motion to dismiss the suit, Niles attorneys wrote, “An applied challenge represents a plaintiff’s protest against how a statute was applied in a particular context… while a facial challenge represents a plaintiff’s contention that a statute is incapable of constitutional application in any context.”

 

Because the case could not withstand a facial challenge, village attorneys say in their motion that the case should be dismissed.

 

People For A Safer Society attorney Anthony Hind said he believes the standard in the gun shop case should rest on the “as applied” standard, based on long-standing state law, and that it should move forward.

I hope to hear that the "People for defenseless sheep" group gets their hand slapped hard today. After losing a fair fight (when the village voted) they attempt to muddy the waters with more lies and egregious statements.

Gun Lawsuit Ruling Expected

 

Attorneys representing anti-gun activists the People for a Safer Society and the village of Niles were in Cook County court Tuesday giving oral arguments for about 45 minutes in a status hearing for a case challenging the villages process for approving a gun shop and shooting range on Caldwell Avenue that has yet to be built. The judge is expected to give a ruling Thursday, May 14 at 3 p.m. in a Cook County courtroom in the Daley Center in Chicago

What's going on AT THE BUILDING?? Or has this lawsuit frozen everything? "a right delayed is a right denied"... which would shine a different light upon the judge.

I don't know, but given the potential for loss of your investment I'd think the building improvements are probably on hold.

I don't know, but given the potential for loss of your investment I'd think the building improvements are probably on hold.

And no bank will lend on a project like this until all the necessary permits, licenses, etc are in place - for exactly the same reason.
