Conservative judges at all levels are, by their nature, not activists, and are thus likely not going to stamp out liberal gun-grabbing BS across the board. Court cases have to be incremental, like D.C. v Heller and McDonald v City of Chicago. As much as I want a "SAF v the Feds" to knock down the NFA, GCA, and all the other nonsense, it's not going to happen.

If Manchin won't vote for it that should bring a 51-49 vote or if he votes 'present" that would leave it 50-49. That is not a tie. Of course that is if all of the RINO's vote as republicans and not once again prove what a pile of crap they are. Jim.

IMO when it comes to something controversial like packing the court, they will likely even find it hard to get the votes in the House from those not in solid blue districts, mid terms are coming sooner than later.

The leftocrats WILL push this through like they pushed through TyanniCare. This was the best case scenario where all but 1 democrat voted for totalitarianism and all RINOpublicans plus 1 democrat voted against it.

 

The RINOpublican party won't do anything about this. They're utterly powerless.

I'm assuming the numbers in the Wikipedia link are accurate. When the Affordable Care Act was passed, the Democrats had a 58-40-2 advantage in the Senate. The 2 independents voted with the Democrats to end cloture.

 

On December 23, the Senate voted 60–39 to end debate on the bill: a cloture vote to end the filibuster. The bill then passed, also 60–39, on December 24, 2009, with all Democrats and two independents voting for it, and all Republicans against (except Jim Bunning, who did not vote).

 

That majority does not exist today. Convincing 10 Republicans to end debate OR all 50 Democrats to invoke the nuclear option will be a difficult task. I'm more concerned about the latter happening. Having the fate of SCOTUS depend on 1 or 2 Democrat Senators is a scary proposition.
