r4ndy Posted June 19, 2013 at 02:48 PM Posted June 19, 2013 at 02:48 PM As an IL North suburban FOID holder can I legally bring a couple handguns into Chicago and leave them cased and unloaded in my car while having lunch? If it is legal to transport in this manner, are there any handgun mag capacity issues I need to be aware of? I decided this wasn't worth even the smallest risk of the law and I am even more concerned about theft, but I am still interested in understanding the legality.
cm.stites Posted June 19, 2013 at 03:03 PM Posted June 19, 2013 at 03:03 PM its totally legal as it is transport... cook does have a mag limit but as long as they are in your trunk i dont think they would know anyways..
KarlJ Posted June 19, 2013 at 03:06 PM Posted June 19, 2013 at 03:06 PM Chicago does have a magazine restriction, I believe it's 10. Cook co. has a mag restriction. I think 12rnds. I could be confusing the 2?Apparently you can transport through Chicago as long as the gon is not in the city for 24hrs. Any longer requires you register the firearm.Depends on the officer though. Chicago seems to operate on their own rules. There are stories to persons that are non residents of Chicago who were legally transporting and were still charged and had firearms confiscated. If quinn signs 183 then all those troubles go bye bye(in theory). 183 makes the possession and transport of handguns a state function. Localities will have to operate under state law in regards to handguns and ammunition.
KarlJ Posted June 19, 2013 at 03:14 PM Posted June 19, 2013 at 03:14 PM Get a safe for your vehicle and do not disclose the contents. Get pulled over inform the officer that you invoke the fifth. You do not authorize any search or seizures of your person or propertyDo you believe I have committed or will commit a crime?Am I free to go?You need not say anything else or answer questions. Just don't resist and if they violate any of your rights you atleast have a case.
vactor Posted June 19, 2013 at 03:39 PM Posted June 19, 2013 at 03:39 PM when if they violate any all of your rights you at least have catch a case.fixed it for you welcome to chicago
Tvandermyde Posted June 19, 2013 at 03:45 PM Posted June 19, 2013 at 03:45 PM Not by city ordinance they could impound your vehicle
BrowningHP Posted June 19, 2013 at 03:45 PM Posted June 19, 2013 at 03:45 PM Chicago does have a magazine restriction, I believe it's 10. Cook co. has a mag restriction. I think 12rnds. I could be confusing the 2? I'm not so sure thats the case... Midwest in Lyons (Cook co) sells rifles with mags well over 12rd capacity, doesn't that mean there is no restriction in cook at large?
wtr100 Posted June 19, 2013 at 04:11 PM Posted June 19, 2013 at 04:11 PM At what point in the encounter does the 'hickory shampoo' commence?
borgranta Posted June 19, 2013 at 04:30 PM Posted June 19, 2013 at 04:30 PM Wait until the carry law as written is passed is sign by Quinn or overridden by the legislature since it preempts firearm transportation from local firearms laws.
chevsuz12 Posted June 19, 2013 at 04:41 PM Posted June 19, 2013 at 04:41 PM I travel with mine frequently to the airports and even have TSA inspect the contents, and they clearly see a 16rd and 13rd mag, and no problems at all. Granted, the airport is more under federal jurisdiction, but still in Chicago and Cook county.
r4ndy Posted June 19, 2013 at 05:06 PM Author Posted June 19, 2013 at 05:06 PM Thanks for the info folks. I did see the 24 hr law KarlJ referenced in the thread in several places online, but the copy (not on an official Chicago website) of an old ordinance I found stated the 24 hr rule was for interstate travel, so I wasn't sure if this would apply for me coming from my residence in Northern IL after a range visit in-between home and Chicago.
Tango7 Posted June 19, 2013 at 05:34 PM Posted June 19, 2013 at 05:34 PM Had the son of a co-worker get pulled over in the City - he probably squealed his tires or some such. During the stop they discovered his cased Mossberg shotgun and charged him with possession of an unregistered firearm (even w/o his being a resident). Long story short they dropped the charges in return for his surrendering the gun. It wasn't worth the cost of a lawyer - even his uncle, who is one - for a $200 shotgun. Hey - another "gun off the street" in the "war on gangs and drugs".
Ccc2003 Posted June 19, 2013 at 05:35 PM Posted June 19, 2013 at 05:35 PM after all of the attitudes of the last few years from Chicago,I will never set foot in Chicago or spend a dime there with a gun or with out a gun again. All the ground is radioactive and not worthy of my foot prints there.
Patriots & Tyrants Posted June 19, 2013 at 05:37 PM Posted June 19, 2013 at 05:37 PM Its simply if you get pulled over for some reason refuse a search of your car. Todd; wasn't there a case earlier this year of a suburban gun owner being arrested for UUW and failure to have a CFP because he stopped in Chicago to drop a friend off on his way back from the range? I need to hunt up the story but I think the rifle was cased too. Not sure what if anything became of it. after all of the attitudes of the last few years from Chicago,I will never set foot in Chicago or spend a dime there with a gun or with out a gun again. All the ground is radioactive and not worthy of my foot prints there. Easier said than done; Unless you like to detour all the way around the city on I80 then go up 355 to 290 to 53 there is no good way to go from South of the city to South East Wisconsin. Same goes for the reverse; if you live North of the city(like me) and want to go anywhere south of the city your only option is a big detour to the west down the 53/290/355 corridor.

Its the Chicago by pass for 94. You will still be in Cook but you won't touch Chciago (except when you drive past O'hare.)
Patriots & Tyrants Posted June 19, 2013 at 06:21 PM Posted June 19, 2013 at 06:21 PM For a moment there you are in Chicago. In general though I think the CPD does not do many traffic stops on the highway.

KarlJ Posted June 20, 2013 at 12:20 AM Posted June 20, 2013 at 12:20 AM I can't wait till 183 becomes law. I'm a plumber by trade and sometimes work in some sketchy areas. Was just around 83rd and cottage grove on Monday. It's bad enough I gotta worry about my safety but I have to worry about being criminalized by Chicago PD even if I transport. I know 183 isn't perfect but just the fact that I can transport my glock in a zipper case and have a loaded magazine on my hip when I'm in Chicago is truly a blessing, gonna be even better when I get my permit.

ISP patrols the interstate highways throughout Chicago. If you see a CPD unit, it's because the cop is going somewhere, not patrollng.

Cook County limits the mags to 10 unless a home rule unit says otherwise, which is how Chicago in Cook has a 12 round limit Midwest can sell 30 rounders.
