Question on “effective date” of new law

I’m looking through this new law and it states “effective date” several times. Is the effective date January 10th 2023, the day Pritzker signed the bill, or the date the law goes into effect, January 1 2024?

Different parts have different effective dates.

 

"Universal" background checks were scheduled to come into effect from FOID "modernization" on January 1, 2024, but the bill moved that up to July 1, 2023.

 

Sales of "assault" weapons and "large capacity" magazines are prohibited immediately.

 

Possession of "assault" weapons is prohibited as of January 1, 2024 (unless registered).

 

Possession of "large capacity" magazines is banned 90 days from Tuesday, January 10, 2023 (so that's Monday, April 10, 2023).

Registration is January 1 2024 correct?

From somewhere be who might have this info or can point to the text/language.

 

How many AWB’s would I be able to register?  All, Half, One. Of course the option for no none.  But IF someone has say several of these, do they all have to get registered?

You are looking for the term 'endorsement' not registration. 

 

(hhh) Information submitted to the Department of State Police in an affidavit or application for an assault weapon endorsement, assault weapon attachment endorsement, .50 caliber rifle endorsement, or .50 caliber cartridge endorsement under the Firearm Owners Identification Card Act.

 

(b) The Illinois State Police shall adopt rules in accordance with this Section for the electronic submission of an endorsement affidavit.

 

(3) the make, model, caliber, and serial number of the .50 caliber rifle or assault weapon or assault weapons listed in paragraphs (J), (K), and (L) of subdivision (1) of subsection (a) of this Section possessed by the affiant prior to the effective date of this amendatory Act of the 102nd General Assembly and any assault weapons identified and published by the Illinois State Police pursuant to this subdivision (3). No later than October 1, 2023, and every October 1 thereafter, the Illinois State Police shall, via rulemaking, identify, publish, and make available on its website, the list of assault weapons subject to an endorsement affidavit under this subsection (d). The list shall identify, but is not limited to, the copies, duplicates, variants, and altered facsimiles of the assault weapons identified in paragraphs (J), (K), and (L) of subdivision (1) of subsection (a) of this Section and shall be consistent with the definition of "assault weapon" identified in this Section. The Illinois StatePolice may adopt emergency rulemaking in accordance with Section 5-45 of the Illinois Administrative Procedure Act. The adoption of emergency rules authorized by Section 5-45 of the Illinois Administrative Procedure Act and this paragraph is deemed to be necessary for the public interest, safety, and welfare. The affidavit form shall include the following statement printed in bold type: "Warning: Entering false information on this form is punishable as perjury under Section 32-2 of the Criminal Code of 2012. Entering false information on this form is a violation of the Firearm Owners Identification Card Act."

I wonder out loud how someone who, hypothetically, owns a few assembled AR15 lower receivers - the 'legal' firearm -  with as yet no stocks or matching complete uppers for them would fill in an honest answer to the question of "caliber". The possible options for caliber and even rifle or pistol are pretty numerous.

So even if you register your current weapons subject to the law and listed in the law, the ISP could later update that list for more weapons making you a criminal without your knowledge.

Sure would be good to have an IGOLD event April 9 so everyone can be in public carrying empty “large capacity” magazines to remind them of what is already in the wild.
