Presidential candidate Beto O'Rourke said "there have to be consequences" for gun owners who do not surrender their AR-15s, which would include police going to their homes and confiscating them.

 

The former Democratic Texas congressman was pressed by "Morning Joe" host Joe Scarborough on Wednesday after the fourth Democratic presidential debate.

 

"OK, but lets just assume theres a rancher in Texas that doesnt, that says, 'Im not going to do this because this is an unjust law and its unconstitutional.' Whats the next step? I think thats what we need to concede because there will be people that dont turn the guns back in. Whats the next step for the federal government there?" Scarborough asked.

 

"Yeah, I think just as in any law that is not followed or flagrantly abused, there have to be consequences or else there is no respect for the law," O'Rourke replied. "So you know, in that case I think there would be a visit by law enforcement to recover that firearm and to make sure that it is purchased, bought back so that it cannot be potentially used against somebody else."

The U.S. attorney for the Northern District of Illinois, whose office has responsibility for Chicago, has for years maintained a policy of refusing to prosecute most straw-buyer cases unless they are part of a larger organized-crime investigation, partly because those cases are a lot of work and partly because they tend to net a lot of sympathetic defendants, the girlfriends and grandmothers and nephews with clean records who buy firearms illegally for convicted felons.

If the US Attorney doesn't have the stomach to prosecute someone who is knowingly buying forearms for convicted felons, what makes him think they'll have the stomach to prosecute someone who kept a rifle they purchased legally? Let alone how enforcement agencies will feel about taking those rifles.

I've offered people the opportunity to walk the neighborhoods I used to work in East St Louis (and stack up on doorways going after TRUE bad guys) on a warm summer weekend evening...no takers. He can put his @$$ where his mouth is - but won't.
