HA1 to HB4754 Crim Cd 3D Firearms Prohibits was adopted in committee and the bill aproved for consideration of the full House. This bill is now at second reading.

 

HA2 to HB5523 Crim Cd Seizure Vehicles was adopted in committee and the bill reported as do pass as amended. It is now at second reading as well.

Yesterday in the House, H4290 Certified Firearms Instructor was moved to third reading.

In House committee. a bill on which we filed witness slips in oppostion was amended by adoption of House Amendment 1. With this change, our position on HB5406 Crim Cd Explosives will be moved to neutral. Thanks to all who contributed their time and effort toward affecting this change.

HB5514 Trapped Animals .22 Caliber also moved to third reading




The House is scheduled for 12:30 PM today and the Senate for 12:00 Noon.

HB4226 Wildlife Bobcat Hunting

Synopsis As Introduced

Amends the Wildlife Code. Removes the prohibition on taking bobcats in the State. Provides that it shall be unlawful for any person to trap or to hunt bobcats with gun, dog, dog and gun, or bow and arrow, except during the open season which will be set annually by the Director of Natural Resources between 12:01 a.m., November 1 to 12:00 midnight, February 15, both inclusive. Provides that the season limit for bobcat shall not exceed one bobcat per person per season. Provides that the pelts of bobcats shall be tagged in accordance with federal regulations and the Department of Natural Resources may require harvest registration and set forth procedures, fees for registration, and the process of tagging pelts in administrative rules. Provides that bobcats may be taken during the open season by use of a small light which is worn on the body or hand-held by a person on foot and not in any vehicle.

Provides that the season limit for bobcat shall not exceed one bobcat per permit.





HB4290 Certified Firearms Instructor

Synopsis As Introduced

Amends the Firearm Concealed Carry Act. Provides that a certified firearms instructor who knowingly provides or offers to provide a false certification that an applicant has completed firearms training as required under the Act is guilty of a Class A misdemeanor. Provides that a person guilty of this violation is not eligible for court supervision. Provides that the Department of State Police shall permanently revoke the firearms instructor certification of a person convicted of this violation. Amends the Unified Code of Corrections to make a conforming change. Effective immediately.





HB4377 Archery Equipment Transport

Synopsis As Introduced

Amends the Wildlife Code. Provides that a bow and arrow device may be possessed or carried in a vehicle without being unstrung, enclosed in a case, or otherwise made inoperable.


House Floor Amendment 2

Removes the provision that to lawfully carry a gun a person may render it inoperable as an alternative to carrying the gun unloaded and enclosed in a case. Provides that uncased crossbows must be uncocked. Adds an immediate effective date to the bill.

I'll be tuning in to committees this morning as I am able. We're starting to build toward some telling discussions on changes to the CC bill - both good and bad.

Kind of reminds me of this whole process last year. listening to committee meetings, fast and furious witness slip filing with changes to committee assignment or late filing coming left and right... Such is life with politics as usual in Illinois.

When the Judiciary Committee adopted HA2 to HB5523 Crim Cd Seizure Vehicles the sponsor testified that there was a great deal of opposition to the bill. She stated her assumption that the opposition "would go away" with adoption of the amendment because it removes all of the 20+ violations that would have been added, except retail theft.

 

Having read the amendment again I don't see this intent. Perhaps there is a third amendment to be filed.

Mr. Sims claims, displaying his lack of understanding, that these guns would violate the law by allowing manufacture of guns with no metal parts.

 

The Illinois Firearms Association removes it's opposition based on amend 1.

 

Mr Vandermyde speaks to the problem of an entrepreneur trying to manufacture unregulated parts. The ATF tried to replicate the plastic gun on the internet - it blew up. There is no problem to be solved.

Mr. Sims states that's (parts manufacture) covered under the manufacturer portion of the bill, as a manufacturer who wants to get a patent.

 

He did not answer the question of the average person wanting to make a part that is not a gun. He suggests that they move the bill and fix it on second.

Mr. Vandermyde clarifies that he cannot sell manufactured guns out of his garage, but there is an allowance in Federal law to manufacture a gun for one's own use.

 

 

Ms. Nekritz ask Mr Sims if his bill allows for something that is already legal. Mr. Sims answers no, but stresses his belief that "there are going to be problems" He further states that he doesn't want $25 guns to be available.

 

The committee reports do pass as amended on a vote of 10/6 with the understanding that further discussion will occur.

Mr. Reboletti introduces HB5773 - expressing no interest in first time violators, he says most people arrested are felons already and are able to bond out quickly.

 

 

Mr. Reboletti continues his tack that most people are gang members from whom a large bond is required.

Ms. Nekritz asks if the intent is to move a source of bond hearing up front. The answer is a source of bond hearing is often not included in these proceedings.

 

Ms. Nekritz: So the goal is to keep these people jailed if the money is not from a legitimate source?

 

Mr. Reboletti: The goal is to keep gang members in jail.

 

Ms. Nekritz: I'm trying to understand what you're trying to accomplish. Keep people in jail?

 

Mr Reboletti: The goal is to make sure the money comes from a legitimate source (contradicting his earlier statement).

The committee is in recess until tomorrow.

 

 

 

It should be noted that Mr. Reboletti, in his own words, worked closely with representative Zalewski on this bill.

 

Mr. Zalewski is a well known anti-gun representative recently made famous by his desire to legalize cocaine in order to institutionalize gun offenders who might have made a simple, nonviolent mistake in where they possess a firearm.
