Hope this helps the stuff in Black type and Red type in the boxes are what you need to fill out basically with your own info for manufacturer, caliber etc.... I'll redo this tomorrow when I have more time.

So, if I wait for my tax stamp to buy a manufactured SBR, like Daniel Defense MK18, do I fill out a form 1? Also, do I still have to engrave the receiver?

Negative, wherever you buy the MK18, already manufactured and registered from the factory SBR from. It has to transfer to an IL dealer of 01/03 (class 3 dealer) or 02/07 (SOT manufacturer). Then the dealer does a FORM 4 to transfer the SBR to you no engraving required you take the FORM 4 filled out from the dealer to the CLEO get signature then send to ATF then the dealer calls you when stamp arrives and you can enjoy your new SBR.

FORM 1 is to manufacture a SBR out of a gun you already have or want to build. If you buy a factory made SBR (DD MK18) you get it transfered on a FORM 4. Again with no engraving required since it was registered with the ATF by the manufacturer (DD) at the point of assembly as an SBR you use a FORM 4 from the dealer you will pick it up from. Make sense?

I have meeting with a bunhc of law enforcement. If he is there, I will talk to him, and I will be talking to the SA as well.

 

Todd, any update on the new Kane County Sheriff? What about the Saint Charles police chief?

I would like to know too before I waste my time.

 

 

So it's OK to waste Todd's time? I am assuming that he is a very busy man, and just 1 man at that working not only for our interest but for all gun owners in IL. If you really want an SBR, why would you not try and do it on your own first? Sure, my first attempt failed but I was persistent and ultimately walked away with a signed Form 1 and now I'm getting ready to take in 2 more.

 

Now... where the heck is my stamp?!?! (Pending as of 11/6 per BATFE).

 

Seriously, how is trying to get a Form 1 a waste of time. The C&R alone seems worth it. Also, lets say you get your form 1 and Illinois decides that having SBRs is a loophole and decide to pass laws to make it illegal to have SBRs. You can still take that SBR and turn it back into a regular rifle (I would notify the ATF that the SBR is no longer a thing). I don't see any losses here at all. Am I wrong here?

Just to clarify. Once and SBR ALWAYS an SBR. There is no legal way to convert it "back to a regular rifle and notify the ATF that it's no longer a thing." You can have it destroyed or sold. But once it's an NFA item that's that.

 

What the folks are complaining about is going through the hassles only to be told no by the CLEO. that's kind of a PITA and folks, myself included, are looking to do some legwork BEFORE we get all the other ducks in a row and are told NO.

Completely incorrect. In fact you can temporarily convert to a non-SBR for interstate transportation without a 5320.20 form, then change back at a later time. Or change back to a Title 1 configuration permanently, and advise NFA to cancel the registration.

You have all these people to pick from.

  • Chief of Police for the maker’s city or town of residence,
  • Sheriff for the maker’s county of residence
  • Head of the State Police for the maker’s State of residence
  • State or local district attorney or prosecutor having jurisdiction in the maker’s area of residence
  • or another person whose certifcation is acceptable to the Director, Bureau of Alcohol, Tobacco and Firearms and Explosives.

One of those is bound to sign it. Figure out how much you really want that SBR and see if it is worth it or not. Personally I want to feel like I live in the USA so I am going to take this all the way to the top. :phone:

 

The only thing I would be a bit afraid of, and this might be an irrational fear, is that someday someone in IL might say that it was a typo and shazam! SBRs are now illegal in IL. But again, at that point just turn it into a rifle. Oh yeah! :cool:

I'm really new to all of this and am trying ot get my ducks all lined up here.

 

Living in Madison County I don't know if the Chief will sign these or not. We don't live in a town so there's nobody below him to start. But what about the fingerprint cards? I know BATF will send them to me but do they have to be done by local law enforcement or can I just roll my own?

 

Sorry for the questions but I did a search and couldn't find the info.

 

FYI my C&R is on its way. One step down. :phone:

Good to know. I rather make it more official and get the fingerprints done at a police department, I have to go there for the signature anyways so might as well. Then if there is a complaint about smugy prints I can at least blame someone else, haa.

 

I have a question about engraving. My name and address are pretty long 15 letters for my name and then 15 for my city and state. As far as approved "Additional description" what else can I use? Or do I just have to tell the engraver to try to make it all fit in a small section on the lower?

 

Nevermind, just got off the phone with an ATF rep and he said full name, city, and state are the requirements.

Not that it really matters...but I've decided to pass on a SBR for now. The issue with a C&R expiring and not allowing for a NFA trust is a no-go for me. I do not want to leave my wife/family in a pickle should I pass unexpectedly.

 

I could probably live with the "gotta upkeep my C&R" but the lack of a trust is really the killer in my mind...
