This bill, having previously passed the Senate, will now be sent to the governor for signature. Except for HB5745 the following bills had their deadline extended to 5/28/2010. HB5745 had previously passed the Senate with amendments and is still in the House for concurrence. All are on tody's House calender. The House is scheduled for 4:00 PM. The Senate is not schedule to convene today. HB173 - Firearm Transport Green/Good House Sponsor: Phelps, Verschoore. Cultra, Reis, Cavaletto, Dugan, Gordon, FliderStatus: Third Reading Synopsis As Introduced Amends the Criminal Code of 1961. Provides that a unit of local government, including a home rule unit, may not regulate the transportation of firearms and may not regulate the transportation of ammunition, components, accessories, or accoutrements for firearms. Provides that the provisions of any ordinance or resolution adopted before, on, or after the effective date of the amendatory Act by any unit of local government that imposes restrictions or limitations on the transportation of firearms and ammunition, components, accessories, and accoutrements of firearms in a manner other than the requirements that are imposed by the Deadly Weapons Article of the Code are invalid and all those existing ordinances and resolutions are void. Provides that this provision is a limitation of home rule powers under subsection (h) of Section 6 of Article VII of the Illinois Constitution. Effective immediately HB5231 - Possessing Firearm Green/Good House Sponsor: Bradley, Beiser Status: Second Reading Synopsis As Introduced Amends the Criminal Code of 1961. Provides that the provision prohibiting a person from carrying or possessing any firearm, stun gun, or taser or other deadly weapon in any place which is licensed to sell intoxicating beverages, or at any public gathering held pursuant to a license issued by any governmental body or any public gathering at which an admission is charged does not apply to any owner of such facility or to his or her employees if the owner has given permission to possess a firearm. Effective immediately. HB5480 - Private Sales Red/Bad House Sponsor: Osterman, Hernandez, Burns, Flynn-Currie Status: Second Reading Synopsis As Introduced Amends the Firearm Owners Identification Card Act. Provides that a person who is not a federally licensed importer, manufacturer, or dealer and who desires to sell or transfer a firearm of a size that may be concealed upon the person to another person, who is not a federally licensed importer, manufacturer, or dealer, shall do so only at the place of business of a federally licensed firearm dealer. Provides that the federally licensed firearm dealer shall conduct a background check on the prospective recipient of the firearm and follow all other applicable federal, State, and local laws as if he or she were the seller of the firearm. Provides that the purchaser or transferee may be required by the federally licensed firearm dealer to pay a fee not to exceed $10 per firearm, plus other authorized fees. Makes exceptions for (i) the transfer of a firearm between spouses, a parent and child, or other family members, (ii) transfers by persons acting pursuant to operation of law or a court order, or (iii) transfers on the grounds of a gun show. House Floor Amendment No. 1 Adds reference to: 430 ILCS 65/3.1 from Ch. 38, par. 83-3.1 Further amends the Firearm Owners Identification Act. Provides that the Department of State Police shall develop an Internet based system for individuals to request the Department of State Police to conduct an instant criminal background check prior to the sale or transfer of a handgun. Provides that the system shall be completed and available by July 1, 2012. State Debt Impact Note (Admin Office of the Illinois Courts)HB 5480 would not change the amount of authorization for any type of State-issued or State-supported bond, and, therefore, would not affect the level of State indebtedness. Judicial Note (Admin Office of the Illinois Courts)HB 5480 would neither increase nor decrease the number of judges needed in the State. Pension Note (Government Forecasting & Accountability) HB 5480 will have no fiscal impact on any pension fund or retirement system in Illinois. Correctional Note, House Floor Amendment No. 1 (Dept of Corrections) This legislation has no fiscal or population impact on the Department. State Mandates Fiscal Note (Dept. of Commerce & Economic Opportunity) HB 5480 does not create a State mandate. Home Rule Note (Dept. of Commerce & Economic Opportunity)HB 5480 does not pre-empt home rule authority. Land Conveyance Appraisal Note, House Floor Amendment No. 1 (Dept. of Transportation)No land conveyances are included in HB 5480 (H-AM 1), therefore, there are no appraisals to be filed. Pension Note, House Floor Amendment No. 1 (Government Forecasting & Accountability)HB 5480 (H-AM 1) will have no fiscal impact on any pension fund or retirement system in Illinois. State Debt Impact Note, House Floor Amendment No. 1 (Government Forecasting & Accountability)HB 5480 (H-AM 1) would not change the amount of authorization for any type of State-issued or State-supported bond, and, therefore, would not affect the level of State indebtedness. Fiscal Note, House Floor Amendment No. 1 (Illinois State Police)It is difficult to estimate how many private transactions would be conducted, but the Illinois State Rifle Association (ISRA) provided the estimate of 260,000 transactions. The Firearm Transfer Inquiry Program (FTIP) would see a significant increase in the number of transactions needing to be processed. It is believed additional personnel and IT resources would be needed to avoid processing delays. It is not unreasonable to estimate start-up and out year costs to exceed $250,000 based on the ISRA estimate. The preliminary estimates include: (1) 4 Office Associates (@$60,000) = $240,000; (2) 5 Computers (@ $1,500) = $7,500; (3) 5 FTIP phones (@$1,000) = $5,000; (4) 1 Supervisor = $80,000; (5) System Modifications = $50,000; Total = $382,500. The amendment requiring an Internet based system be in place by 2012 will require funding in advance. $2 million in FY11 and $1.5 million in FY12 will be needed, but has not yet been identified. Housing Affordability Impact Note, House Floor Amendment No. 1 (Housing Development Authority)This bill will have no effect on the cost of constructing, purchasing, owning, or selling a single-family residence. Balanced Budget Note, House Floor Amendment No. 1 (Office of Management and Budget)The initial cost associated with HB 5480 (House Amend. 1) is $382,500. This estimate does not include additional implementation costs that cannot be identified at this time. Additionally, no funding source is identified in the legislation, so it is reasonable to assume any associated implementation costs would be absorbed by the General Revenue Fund. Changes references in the statute on unlawful sale of firearms from "sell" or "give" to "transfer". Prohibits multiple sales of handguns within a 30-day period. Creates the offense of unlawful acquisition of handguns. Provides exemptions and affirmative defenses. Penalty is a Class A misdemeanor for a first offense and a Class 4 felony for a second or subsequent offense. HB5745 - Medical Personel (Enhanced Penalties) Blue/Neutral House Sponsor: Saviano, Feigenholtz, Reboletti, Zalewski, Davis (Monique)Senate Sponsor: Harmon, HaineStatus: House Concurrence Synopsis As Introduced Amends the Criminal Code of 1961. Provides for enhanced penalties for murdering, assaulting, battering, or discharging a firearm or machine gun at a physician, physician assistant, nurse, or advanced practice nurse when the defendant knows such person's status. House Floor Amendment No. 1 Provides that the enhanced penalties also apply to committing the various offenses against psychologists. Senate Committee Amendment No. 1 Deletes reference to: 720 ILCS 5/12-2 from Ch. 38, par. 12-2 720 ILCS 5/12-4 720 ILCS 5/12-4.2 from Ch. 38, par. 12-4.2 720 ILCS 5/12-4.2-5 720 ILCS 5/24-1.2 from Ch. 38, par. 24-1.2 720 ILCS 5/24-1.2-5 Replaces everything after the enacting clause. Amends the Criminal Code of 1961 and the Unified Code of Corrections. Provides that A defendant who has been found guilty of first degree murder and who at the time of the commission of the offense had attained the age of 18 years or more may be sentenced to natural life imprisonment if (i) the murdered individual was a physician, physician assistant, psychologist, nurse, or advanced practice nurse, (ii) the defendant knew or should have known that the murdered individual was a physician, physician assistant, psychologist, nurse, or advanced practice nurse, and (iii) the murdered individual was killed in the course of acting in his or her capacity as a physician, physician assistant, psychologist, nurse, or advanced practice nurse, or to prevent him or her from acting in that capacity, or in retaliation for his or her acting in that capacity. HB5751 - Assault Weapons Red/Bad House Spondor: Acevedo, Berrios, Jefferson, HernandezStatus: Second Reading Synopsis As Introduced Amends the Criminal Code of 1961. Provides that 90 days after the effective date of this amendatory Act, it is unlawful for any person within this State to knowingly manufacture, deliver, sell, purchase, or possess or cause to be manufactured, delivered, sold, purchased, or possessed a semi-automatic assault weapon, an assault weapon attachment, any .50 caliber rifle, or .50 caliber cartridge. Provides that beginning 90 days after the effective date of this amendatory Act, it is unlawful for any person within this State to knowingly manufacture, deliver, sell, purchase, or possess or cause to be manufactured, delivered, sold, purchased, or possessed a large capacity ammunition feeding device. Provides that these provisions do not apply to a person who possessed a prohibited weapon, device, or attachment before the effective date of this amendatory Act if the person has provided proof of ownership to the Department of State Police within 90 days after the effective date of this amendatory Act. Provides that on or after the effective date of this amendatory Act, such person may transfer such device only to an heir, an individual residing in another state maintaining that device in another state, or a dealer licensed as a federal firearms dealer. Specifies penalties for violations. Provides exemptions. Provides that the provisions of the Act are severable. Effective immediately. House Floor Amendment No. 1 attempts to make this bill palatable by recognizing the rights of non-Illinoisans while infringing the rights of residents of the state the sponsor purports to represent: 2 AMENDMENT NO. ______. Amend House Bill 5751 on page 6, by 3 replacing line 10 with the following: 4 "those items, or to persons who are dealers or importers 5 licensed under Section 923 of the federal Gun Control Act of 6 1968 if they are located in another state, or to an individual 7 residing in another state and maintaining those items in 8 another state; or the possession of those items solely for the 9 purpose of conducting an activity otherwise exempted by this 10 subdivision (4)."; and 11 on page 11, by replacing line 4 with the following: 12 "possess those items, or to persons who are dealers or 13 importers licensed under Section 923 of the federal Gun Control 14 Act of 1968 if they are located in another state, or to an 15 individual residing in another state and maintaining those 16 items in another state; or the possession of those items solely 17 for the purpose of conducting an activity otherwise exempted by 09600HB5751ham001 - 2 - LRB096 18507 RLC 40740 a 1 this subdivision (4).". HB5849 - Firearm Transport Red/Bad House Sponsor: Osterman, Davis (William), Hernandez, Burns, Flynn-CurrieStatus: Third Reading Synopsis As Introduced Amends the Criminal Code of 1961. Provides that the exemption from violations of the unlawful use of a weapon statutes for carrying firearms applies to portable containers designed for the safe transportation of firearms (rather than any container). Effective immediately. House Floor Amendment No. 1 makes several changes, including: adding the following to the definition of "unlawful sale of firearms" House Floor Amendment No. 1 Adds reference to: 720 ILCS 5/24-3 from Ch. 38, par. 24-3 Further amends the Criminal Code of 1961. In the exemption from a violation of the statutes concerning unlawful use of weapons and aggravated unlawful use of a weapon, provides that the transportation of the weapon must be unloaded and enclosed in a firearm case, carrying box, shipping box, or a similar portable (rather than any portable) container designed for the safe transportation of firearms. Provides that it is a Class 1 felony to sell or give a firearm to a person whom the seller or giver knows is a street gang member. State Debt Impact Note (Government Forecasting & Accountability)HB 5849 would not change the amount of authorization for any type of State-issued or State-supported bond, and, therefore, would not affect the level of State indebtedness. Judicial Note (Dept of Commerce and Community Affairs)HB 5849 would neither increase nor decrease the number of judges needed in the State. Some days I just want to vote with the "No Incumbent" crowd. I know there are a bunch of "good guys" there. My Rep and Senator can't be beat. But, can't the good guys across the state get together, march into Madigan's office and threaten to wring his neck, literally, unless things change?? It's as if no one has the *jewels* to do anything about it. Sigh, tomorrow, different day, same ***t. AB
