The individual is challenging the arrest. The case will most likely be made that none of the other Constitutional rights stop at a State border, but are valid anywhere in the US. Think of this case like a Maryland version of Bernie Goetz. He had a firearm that was technically illegal. He shot someone. It didn't make constitutional law. It didn't even make precedent really. It did make NYC change it's law enforcement policies (a little). He was still convicted of illegal possession.
