TomKoz Posted January 12, 2013 at 12:46 AM Share Posted January 12, 2013 at 12:46 AM It is high time the States and the People but the brakes on the overreach of the Federal government!
kevinmcc Posted January 12, 2013 at 02:22 AM Share Posted January 12, 2013 at 02:22 AM Can not be done without legislation, so executive orders will be unconstitutional as SCOTUS has already ruled unconstitutional.
RockerXX Posted January 12, 2013 at 02:59 AM Share Posted January 12, 2013 at 02:59 AM Would have been nice if touched a little bit more on Miller in the context of 'common use' to clarify the "dangerous and unusual" wording in Heller...

44Brent Posted January 12, 2013 at 10:04 PM Share Posted January 12, 2013 at 10:04 PM Given discussions on what Obama might do through Executive Orders to implement his agenda, it is important to understand that historically, Presidents have successfully used EOs in completely unlimited ways. Example 1: Executive Order 6102 is an Executive Order signed on April 5, 1933, by U.S. President Franklin D. Roosevelt "forbidding the Hoarding of Gold Coin, Gold Bullion, and Gold Certificates within the continental United States". The order criminalized the possession of monetary gold by any individual, partnership, association or corporation. http://en.wikipedia.org/wiki/Executive_Order_6102 Example 2: President Franklin D. Roosevelt authorized the internment [of American citizens of Japanese descent] with Executive Order 9066, issued February 19, 1942, which allowed local military commanders to designate "military areas" as "exclusion zones," from which "any or all persons may be excluded." This power was used to declare that all people of Japanese ancestry were excluded from the entire Pacific coast, including all of California and much of Oregon, Washington and Arizona, except for those in internment camps.[8] In 1944, the Supreme Court upheld the constitutionality of the exclusion orders,[9] while noting that the provisions that singled out people of Japanese ancestry were a separate issue outside the scope of the proceedings.[10] The United States Census Bureau assisted the internment efforts by providing confidential neighborhood information on Japanese Americans. The Bureau's role was denied for decades, but was finally proven in 2007.[11][12] http://en.wikipedia.org/wiki/Japanese_American_internment
xmikex Posted January 12, 2013 at 10:32 PM Share Posted January 12, 2013 at 10:32 PM He does a great job of spelling it out. Here's a solid article on the political realities of what we're looking at legislatively and through the EO route. http://thehill.com/homenews/administration/276825-obama-faces-limited-options-on-executive-action-on-gun-violence

As usual, Ben does a good job of covering the topic: http://www.fox19.com...l-can-it-happen I chose to use the link instead of the youtube, so Ben can get some traffic. Sorry for the 15 second ad. 'Tube for those who dont care about showing Ben some love:http://www.youtube.com/watch?v=iQ-ugm0uAu8 He is far too logical. I don't understand how the constitutionality and illegality of these gun laws is constantly pointed out, but they keep making more and running over our rights. ::sigh::
