Illinois Supreme Court Accepts Wilson

I didn't realize semis were banned in Cook. So, you can only own revolvers, bolt action rifles, lever action rifles, and pump shotguns?

 

Not all semi-automatic rifles and pistols, but those with scary accessories and magazines over 10 rounds.

the ban is written so loosely that it could be interpreted as to ban pretty much all semi automatic firearms, but its not strictly enforced (or enforced at all as best i can tell)

 

also, home rule towns can override the county ban, basically outside of chicago its the same as the rest of the state

I was looking up Lincolnwood for a friend. They specifically override Cook County AWB and implement their own which is a list of rifles very similar to the list in Cook/Chicago's old ban with no feature set list.

 

Of interest to him is:

"Cole AR-15"

 

Since his AR-15 isn't a "Cole AR-15" he's technically in the clear.

If a municipality that has home rule enacts its own ordinances regarding "Assault Weapons" than Cook Cty's ordinances do not apply. Yes, a town can ban magazines over X amount of rounds, for any value of X. I believe only counties over 1 million population can be home rule entities, but I am not sure of that. I'm not sure if Dupage has gotten to that level with the new census data.

from the IL constitution:

 

(a) A County which has a chief executive officer elected

by the electors of the county and any municipality which has

a population of more than 25,000 are home rule units. Other

municipalities may elect by referendum to become home rule

units.

Hey farmer don't you have a similar complaint filed?

 

Kinda-sorta. I am challenging a misinterpretation of Chicago's AWB, but not the AWB itself. They define an "Assault Rifle" as a semi-automatic that can accept detachable magazines and has one feature (such as bayonet mount) but have ruled my fixed magazine SKS rifles as having a detachable magazine because they can be modified to accept detachable magazines.
