REPORT: Biden Considers Executive Order Regulating Homemade Guns

The White House is considering several executive orders on gun control, including one that would strengthen regulations of the purchase of homemade or makeshift firearms.

The Biden administration is considering an executive order that would require buyers of “ghost guns,” or firearms that have no serial numbers, to undergo background checks that would close an existing loophole in current laws, Politico reported on Monday.

The White House has discussed the “Charleston loophole” in the last week with Democratic Connecticut Sen. Richard Blumenthal, Politico reported. The loophole allows a firearm to be transferred from a licensed dealer before a background check is completed.

...

An unnamed White House official told Politico the administration was looking at “every tool at our disposal, including executive actions” to achieve President Joe Biden’s promises on guns. The aide reportedly added that some measures included banning assault weapons and repealing manufacturer immunity from liability.

Biden aides were initially reluctant to issue any executive order regarding the Charleston loophole due to the split Senate and indecisiveness on what policies to push, Politico reported. However, the White House is reportedly pushing other measures such as safety storage standards and red-flag laws, which restrict gun ownership if a person is deemed to be a danger to themselves or to others. It is not clear if these measures would be introduced in a bill or through other orders.

Agreed. EO's are supposed to make regulations based on existing law, they cannot be laws of themselves.

The biggest mistake the republicans are making is not challenging everyone of his EO's in court like the democrats did Trump. Get a judge to stay everyone of them. Right now they see that no one is challenging them so it will only embolden them to do more and more. It will continue until they are forced to stop.

What is the “Charleston loophole”?

It's not a loophole its literally by design. It's the ability for an FFL to proceed with the sale after 3 days if the background check doesn't come back as denied. It's literally by design so that (like we currently see in Illinois) the 'authority' can't proxy ban firearm ownership by simply not doing the background checks and deny you your 2nd rights by indefinite delay.

And is the case many times, this by design feature of the law even if 'patched' would not have prevented the Charleston murders.

And remember, they want to implement the Chicago loophole. Where you could only own a gun if your registration was updated and then they stopped accepting new registrations.

Thanks, I thought that might be it but wasn't sure

The problem is the left go after "Z", knowing they can't get it. They want it but they can't get it. SO, the settle for "L" this time. Then they go after "Z" again knowing they can't get it, SO they settle for "N". Then they go after "Z"now again knowing they can't get it but settle for "P". One tiny step at a time but always headed toward their goal of "Z".

Now they are branching out knowing that they can't get "Z" but they can help get there by going after ammo. Lead is a danger to the environment. Back ground checks- that they can delay as long as they can. Enforcing draconian storage requirements. Licenses, red flag laws, etc etc etc

While our side pats themselves on the back for giving them "P" when the left really wanted "Z". Instead they ought to be pushing it back to "L" with the goal of "A".

The left use incrementalism very effectively, that's why we creep very slowly toward totalitarianism.

The right on the other hand, don't know what that incrementalism is.

Honestly I think its because most politicians on the right want "Z" also, they just have to make it look like they don't

Which is why I see the left and right in bed together lots of times, basically [bLANKING] each other furiously.

I don't see much difference between the left and the right - once they're in power, it is the same old song.

Most "politicians" want power and control. They want to be able to tell you what to do, how to do it, when to do it, and what not to do. They can't do that when you have the means to enforce your "I ain't gonna".

A dealer in Illinois must have an approval from FTIP before they can transfer a firearm. Could be instant, could be 3 weeks.

Some do not agree with the ISP position but it is on their FAQ

Q. What happens if a customer orders a firearm, and when he or she comes in to pick it up, ISP issues something other than an approval on the FTIP?

A. The actual transfer of the firearm cannot take place until there is an approval from the FTIP system, regardless of when the agreement was reached. If the FFL receives a transaction number, they cannot complete the transfer until they receive an approval
