Oral arguments will be heard Thursday, May 13th.  Cases begin at 9 am but not sure when this case begins.

Case No. 126014 — Guns Save Life, Inc., et al., etc., Appellants, v. Zahra Ali, etc., et al., Appellees. Appeal, Appellate Court, First District
 
It sounds like they're discussing the second one now.  I just tuned in, so I have no idea if they're going in order, though.  Are oral arguments time-limited?

Yes, they are usually given so many minutes to present argument and so many minutes to respond to argument.

The state farm case is ended. Court is recessed for 10 minutes.

I can't tell if the Justice is being a devil's advocate trying to draw out the appelant's logic or if she is trying to argue that a tax is an acceptable "condition" regarding the sale of firearms as defined by Heller.

Responding attorney for Cook County refers to Justice Theis' earlier questioning of the plaintiff in saying that the tax is a valid condition under Heller and therefore constitutional.  Also saying that 2A is not the same as 1A as a right.

The Constitution doesn't define what our individual rights are -- Democrats do.

They referred to a number of different cases with respect to strict scrutiny and other firearm-centered taxes, but I couldn't quote you specifically what was said.  Perhaps Molly caught the details and can explain better.

 

Can ILSC punt this back to the lower courts?  If they do render a decision and don't punt, either way it'll probably go to SCOTUS.

If the County loses I would be surprised if they appealed to the USSC. (1) there’s little chance they win with the current Court makeup; and (2) Seattle probably doesn’t want a National case on this. But, who knows.
