reelpro Posted March 27, 2026 at 02:28 PM Posted March 27, 2026 at 02:28 PM I'm doing a person to person transfer and on the Illinois State Police transfer portal there is the option to let the state police keep the transfer what does this mean?
Euler Posted March 27, 2026 at 09:24 PM Posted March 27, 2026 at 09:24 PM The transferee is required to provide a record of the transfer to an FFL or to the ISP for a person-to-person transfer. A lot of FFLs refuse to keep such records. The requirement is part of PICA. It applies to all firearms.
Tvandermyde Posted March 29, 2026 at 03:23 PM Posted March 29, 2026 at 03:23 PM it means that the State Police are building a registry of firearms people are transferring. I have often thought of starting an FFL in say Tennessee. Since the requirement is to send it to an FFL, it does not state where, charge $5, and then since there is no requirement under ATF rules nor the state of Tennessee to hold these records, promptly shred them. You complied with the law, and so did we while at the same time depriving the gun controllers of what they want.
TomKoz Posted March 29, 2026 at 04:11 PM Posted March 29, 2026 at 04:11 PM How old is the firearm? How old are the involved parties? Hmmm ?

Isn’t it against federal law for any government to build a registry, and why are they being allowed to do so? Edited March 29, 2026 at 10:58 PM by mab22
Euler Posted March 29, 2026 at 11:32 PM Posted March 29, 2026 at 11:32 PM Maybe the ATF (the applicable federal agency) will start enforcing the law about no firearm registries, just as soon as it destroys its own registry.
mab22 Posted March 30, 2026 at 03:34 AM Posted March 30, 2026 at 03:34 AM Is it the ATF’s responsibility to enforce that? I have often wondered, and perhaps you know... is a C&R FFL qualified to keep the records? Thanks, Tim

FOPA is the law that prohibits registries. FOPA is federal law, so it's federal jurisdiction. If not ATF, then who?

Euler Posted March 30, 2026 at 11:37 PM Posted March 30, 2026 at 11:37 PM ATF is a bureau of the DOJ.
SiliconSorcerer Posted March 31, 2026 at 12:25 AM Posted March 31, 2026 at 12:25 AM FOPA - specifically prohibits federal system of gun registration doesn't appear it's illegal for a state.
ealcala31 Posted March 31, 2026 at 03:59 AM Posted March 31, 2026 at 03:59 AM Every person to person transfer can go through an FFL and avoid giving the State of IL all the firearm info on an immediate basis. And yes, not that many FFLs do this, but every community has a few guys that do. So, to be fair, is this about economics? If adding to the gun registry is NOT what you want to do, hire an FFL. But, mostly everyone in IC promotes clicking the box because it's FREE. You tell me...

yurimodin Posted March 31, 2026 at 03:40 PM Posted March 31, 2026 at 03:40 PM What does it say on your FOID card......probably still has the old "seller keeps record for 10 years" on it. Its not my fault you didn't inform all gun owners with official mail after changing the "law".

Thanks, Tim Sorry to chime in... was wondering same. The way it's written says "FFL dealer", which tells me collectors are not qualified. Would like to be wrong lol
