In April 2022 in the Federal District Court of Eastern Virginia, the US charged Patrick Adamiak with possessing and transferring NFA restricted items.

In October 2022, a jury convicted him on all counts (receive and possess unregistered firearm, unlawful possession of "machinegun," receive and possess unregistered destructive device ×3). He was subsequently sentenced to 20 years (240 months, two consecutive 120-month sentences) in prison, followed by 3 years of supervised release.

In June 2023, Adamiak appealed to the 4th Circuit Court.

In October 2025, a 3-judge panel of the 4th Circuit issued an unpublished (i.e., non-precedential) per curiam (unsigned) ruling that his consecutive sentences violated double jeopardy and remanded the case for resentencing. Adamiak had also challenged the sufficiency of the evidence, but the circuit court affirmed the district court. Adamiak moved for an en banc rehearing.

In November 2025, the 4th Circuit denied en banc rehearing.

On February 1, 2026, Adamiak asked the US Supreme Court to extend the deadline for a petition for certiorari from February 10 to March 12. (shadow docket)

In his motion, Adamiak contends that the evidence does not support the charges. The parts he possessed and transferred were inert, non-functional, and which the ATF had allowed in unrestricted commerce for decades.

Adamiak's case has been sponsored by the Firearms Policy Coalition and Maryland Shall Issue.
