SiliconSorcerer Posted July 21, 2025 at 10:26 PM Posted July 21, 2025 at 10:26 PM Friend sent me the paperwork for my opinion. He got his suspended not revolked.. Looks like isp has this screed up a well. Says you have to give your foid to police or a valid foid card holder but then tells you to fill out the revolk form where it says it must be destroyed. So which is it?
Molly B. Posted July 21, 2025 at 11:08 PM Posted July 21, 2025 at 11:08 PM I would need to see from where this information is coming . . . someone seems confused . . .?
SiliconSorcerer Posted July 22, 2025 at 10:46 AM Author Posted July 22, 2025 at 10:46 AM (edited) This is from the letter he received. Note: OR a valid FOID card holder. This is from the isp.illinois.gov/Foid/AppealForms Surrender card to local law enforcement, so which is it? I have his FOID and he has no firearms in his possession. Molly B. Posted July 22, 2025 at 04:25 PM Posted July 22, 2025 at 04:25 PM But his FOID was not revoked, just suspended. Correct? If they say another FOID card holder can hold his FOID, then that is what I would do with the FOID card.

John Q Public Posted July 22, 2025 at 07:12 PM Posted July 22, 2025 at 07:12 PM (edited) SS they want him to fill out firearms dispo form and transfer all the firearms to a valid FOID card holder until this is cleared up. Without the FOID card they may no longer have firearms in their possession. There is a ruling out there which does state, you do not have to have a FOID card for firearms kept in the home; Though this was for one women and is stated somewhere, but I don't think it wise to go down that road. Transfer them, get it cleared up, and go from there. If he owns firearms, even if you, or someone with a valid FOID has them, they need to be called out in the form, as well as the person who now posses them Get an attorney on it. No one can conclude anything from it.
John Q Public Posted July 22, 2025 at 08:08 PM Posted July 22, 2025 at 08:08 PM Thanks for that Euler.
Smallbore Posted July 22, 2025 at 09:26 PM Posted July 22, 2025 at 09:26 PM If you need to temporary transfer guns, do so with a written agreement to get them back. I know of a current situation where a wife used the husband's nephew for this. The situation is past. Now nephew will not return the guns. He claims they were a gift.
Molly B. Posted July 22, 2025 at 09:53 PM Posted July 22, 2025 at 09:53 PM The letter is calling for two actions: Submitting the Firearm Disposition Form AND either submitting the FOID with that form OR have another FOID card holder hold the FOID until the suspension is ended.
SiliconSorcerer Posted July 23, 2025 at 11:50 AM Author Posted July 23, 2025 at 11:50 AM He went to the police station as requested and they asked for his FOID until he showed them the letter, apparently they are not very familiar with suspended vs revolved. They called me to verify I had his card, which I did. Asked him if he had an firearms in his possession, no Good bye and it was over. The transfer of ownership is not required for suspension. Requiring the submitting of the Firearm Disposition Form is incorrect. First line of form "Your FOID has been revoked." - NOPE
John Q Public Posted July 23, 2025 at 05:37 PM Posted July 23, 2025 at 05:37 PM (edited) SS not looking for a fight, but the ISP has you filling a form even if you don't have any firearms. I really don't care how you, and your friend handle this, but having one officer on the phone is not indicative of what the policy is. (Regardless of the law) We all know judges and the law diverge on this subject and to prove innocence, could be a nightmare in court time and costs. I tend to try and keep my people off the radar, if possible. I wish your friend well and hope it's cleared quickly. Edited July 23, 2025 at 05:45 PM by John Q Public
SiliconSorcerer Posted July 24, 2025 at 12:38 PM Author Posted July 24, 2025 at 12:38 PM Signing that form would be committing perjury if your FOID is not revolked.
