mauserme Posted May 29, 2025 at 12:27 AM Author Posted May 29, 2025 at 12:27 AM Mr. Davidsmeier says the sponsor is underestimating the amount of safety gun owners practice, that this could be a good bill if she would work with gunowners.
mauserme Posted May 29, 2025 at 12:28 AM Author Posted May 29, 2025 at 12:28 AM The bill is passed with 69 affirmative votes.
mauserme Posted May 29, 2025 at 12:32 AM Author Posted May 29, 2025 at 12:32 AM And now HB850 Safety - Tech has come out of nowhere, changing the Clear and Present Danger provisions of the FOID Act. The amendment being debated was not filed at 4 PM when I last checked for amendments.
mauserme Posted May 29, 2025 at 12:35 AM Author Posted May 29, 2025 at 12:35 AM Rep. Morgan says this will provide additional due process for those whose FOID Cards are revoked based on incorrect information. Rep. Windhorst wonders if this is in response to legal challenges to Illinois' current Clear and Presents Danger law. Mr. Morgan skirts the issue.
mauserme Posted May 29, 2025 at 12:38 AM Author Posted May 29, 2025 at 12:38 AM Rep. Windhorst asks if this bill has been reviewed for compliance with court due process, not administrative due process, in light of Rahimi and Bruen.

The passage of that bill, even with it being well established that is in direct conflict with established rulings by courts, including S.C.O.T.U.S., is detestable. It bothers me not at all that the “know best” types in the ILGA stand to learn another hard lesson.

The problem is that they haven't learned any hard lessons. The taxpayer-funded legal army of the state is more than happy to do anything within its power to win these cases or go scorched earth and slow things down if there's a chance of losing. The state is biding its time for SCOTUS to be on its side, then all these infringements will magically become settled law.
mab22 Posted May 29, 2025 at 02:40 PM Posted May 29, 2025 at 02:40 PM I think what you are witnessing is the thumbing there noses at the US Supreme Court, current administration, established rule of law, etc, etc. In other recent news there was an article where the IL general assembly is considering following the World Health Organization guidelines instead of the US health guidelines, so there is more going on then just the 2A violations. Look at PICA, a complete violation of darn near everything, but what is stopping them? I think this is what gets referred to as an out of control party that is running all three branches of the Illinois government. And I have NO IDEA on how you stop this other then go to the feds for help!

I also think there's a childish element of payback for Dobbs too, at least for some of them.

When you have suburban women thinking that wearing a MAGA hat is violence and intimidation, that's a rather large demographic that is off the rails and will support anything to "own" conservatives or anything that is perceived to be conservative, like gun ownership.

Hirshauer, getting testy, says "first, no human being is illegal"... Davidsmeier rephrases the question to a person who has entered the country illegally. She answers that they are prohibited because they are not eligible for a FOID card. Davis Meier should be asking: is a person subject to the jurisdiction of another country, who crosses into the united states without proper authorization, is that person a prohibited person?
Gunowner773 Posted June 6, 2025 at 04:52 AM Posted June 6, 2025 at 04:52 AM So no changes have been made for due process to get your FOID card back? How long will this take ? When will the decide ?
