I wanted to clarify as I've seen posts saying the laws have changed recently. I attended an out patient mental health program about 18 months ago and an in patient rehab facility for alcoholism more recently. This was all voluntary and I don't have any criminal record. Also, if I am not able to get my FOID for the entire 5 year period is it still possible to attend a firearm safety class or take a private lesson from an instructor at a facility? Thank you for your help!
John Q Public Posted April 18, 2025 at 05:45 PM Posted April 18, 2025 at 05:45 PM (edited) It was not court ordered, or involuntary , so yes, you should be able to get it as soon as the doc signed off and it goes through channels... Molly, may be able to guide you there. As long as you are prohibited/suspended, not valid a FOID until this is resolved, you may take a class, but you may not handle firearms as a prohibited person until your rights are restored. As an instructor, if you didn't have a FOID, you could use my firearm, but if there is something which prohibits you from getting a FOID, or you are suspended, then it is not lawful for me, or anyone, to let you posses a firearm. Clarity The valid question are did you have a FOID to begin with? According to the law, if you didn't have one before, and were deemed not to be a danger to self or others by your doctor, then one could argue you could handle and shoot a firearm with someone who has a FOID and under their supervision. If you did have a FOID and it was suspended/revoked, then you may not handle/possess/shoot a firearm no matter if you are alone, or if you have a FOID card holder supervising. There is also a part in there which reads if you are addicted to, or unlawful user of drugs or alcohol, or any combination then you are not eligible. This is a bit of a round da round as an addict is always an addict, but one must take into account that anyone could become an addict, or alcoholic at any point.
