Call to Action!
Witness Slips Needed!


 

Today we introduce the first Senate bill this year on which we ask your opposition.


 

On the surface, SB2431 Explosives & Consumer Fireworks appears that it might be an effort to legalize consumer fireworks in Illinois, in the process creating an Illinois Individual Explosives License to be issued by the Department of Natural Resources. Digging a bit deeper reveals the true nature of Senator Doris Turner's bill – to end or severely limit the ability to hand load in this state and, to even make it more difficult to use muzzle loaders for hunting or reenactment. You see, the bill would require a new license, in addition to the FOID card, to possess any explosives included in the Annual List of Explosive Material, a list that has historically included black powder, black powder substitutes, and smokeless powder. As if that weren't enough, hand loaders and reenactors would be required to place a hazard placard on their vehicle when transporting these powders, making vehicle and home burglaries all the more likely. We oppose this bill because of it's effects on our rights, and hope you will, too.

 

Back in the House, Representative Vella's HB1831 Counties Cd – Nuisance would allow counties to define what they consider nuisances, especially sound based nuisances, and “to take all necessary measures to abate” them. As we've seen in the past, efforts have been made to make your outdoor range illegal on this same basis, Amendment 1 on SB571 in the 100th General Assembly being a prime example. Representative Vella's bill would take this further, with an amendment filed to extend this power beyond the county's own borders. This cannot comport with the requirement that gun regulations be consistent with the nation's history and tradition regarding firearms, particularly in unincorporated areas.

 

HB3320 RIFL Act proposes to create a firearm manufacture's license, similar to the dealer licensing requirement that put approximately one half of our firearm retailers out of business. The cost of the license “shall be equal to the public health costs and financial burdens from firearm injuries and deaths”, allowing civil penalties of $1 Million per month. If passed, it would be illegal to sell firearms from a manufacturer that is not licensed by Illinois, even those not located within this state. In short, it would end all retail gun sales.
 

Also from the sponsor of the RIFL Act is HB3692 FOID Card – Fingerprints/Fees, requiring fingerprints when applying for a FOID Card. Make sure to file witness slips opposing this in both the 3/18 and 3/20 hearings.

 

Finally, our head scratcher of the week is HB3188 Consumer Fraud – Firearm Vending, a bill that would outlaw the sale of “a firearm related products” from a vending machine. Ignoring for the moment that sales of firearms cannot currently be done legally from a vending machine because the required background check cannot done, we have to wonder why the sponsor would oppose the sale of foam hearing protection, cleaning products, gun locks, or any of the myriad other unregulated firearm related products that could be conveniently sold from a machine. Help us put an end to this nonsense.

Bans will be struck down, introducing this bill.

 

She can deny all she wants: that is what 

will happen.

 

This will be just as effective as the Illinois 

Real Estate License Act. 

 

This essentially bans all firearms. There is

no distinguishment.

from OUT OF STATE are not subject

Does Hirschauer know this violates

likely, the commerce clause and 

existing federal controls on commercial

Yes. And no.

 

How can a state (Illinois) require a business 

residing in another state to obtain a license to merely

offer for sale items in the state of destination? 

Illinois is not Toronto. It is America.

 

Does Illinois want to ban all imports

of firearms that are transiting federal commerce?

because it looks like that, analyzing this bill.

 

Does Hirschauer want to argue intrastate 

regulation supersedes interstate 

regulation? 

 

We have a beautiful big law called the 1968

Gun Control Omnibus Act. You cannot

ban import of firearms to the state of

Illinois.

 

If Hirschauer hates guns, she should 

move to Canada.

 Additional points on RIFL:

 

Could this be the bare bones for future Illinois regulation

of "assault" weapons and the like when the bans

get struck down?

 

Is California's roster system getting struck down? 

 

What about used gun sales? 

 

It seems they are going

after importers like RGuns

with this.

 

How far does "offer" for sale go? Does

this mean I can't purchase off Gunbroker

and can only buy brand-new, sticker-label

firearms? 

 

IDFPR handling licenses means delays

and worse handling than ISP. 

 

On its own face this bans purchases 

from places like Gunbroker. Unless

they get a "license" which they

probably won't. 

 

Beyond the obvious ban on 

all firearm sales or ability to 

access an offer for sale on

a website like Gunbroker, 

this bill essentially codifies

a legal avenue where

the maker is licensed and 

can be sued at a higher

rate than (ironically) a real-estate

brokerage can be.

 

Federal Licensees should 

not take this bill lightly.

You know, I highly doubt all those people are authorized to speak on behalf of the University of Chicago. It would be a shame if someone reported them.

How many times do we have to file these same slips?

 

I think we've filed them 3 times now. 

 

They changed something a few years ago to make people file more often to make it look like there was no opposition

After a few years now I have realized it's a CONSTANT!
It's like telling a 2 or 3 year to stop doing that! Teaching the kids, or training a new dog or cat is MUCH MUCH easier.

The communist/Marxists democrats are actually WORSE then kids or pets because it is intentional!

I know it can get tedious but this is actually the first time these bills have been posted to committee hearings, so also the first time we've asked for witness slips on these exact bills.  Other group(s) may have sent alerts, too.

We didn't get that into this Call to Action because it wasn't filed until a couple days after the alert went out.

 

The hearing this bill was posted to was yesterday, so I wouldn't worry about it this time around.   We'll pick it up on the next alert if we need to.
