30 GOP Senators Urge ATF to Rescind Regulatory Gun Controls Implemented Under Biden

Thirty Republican Senators have signed a letter urging the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) to rescind regulatory gun controls implemented during the Biden administration.

 

The Senators posited President Donald Trump’s February 7 executive order as the impetus for the letter. Trump used the order “to assess any ongoing infringements” of the right to keep and bear arms.

 

The letter from the senators, revealed Thursday, says in part:

Under former President Joe Biden, ATF adopted numerous policies and rules that infringed upon Americans’ Second Amendment protections. President Trump’s Executive Order directs Attorney General Pam Bondi to review and develop a plan of action regarding President Biden’s unlawful firearms regulations. We ask that you work with the Attorney General to quickly identify and rescind these policies.

It continues, “In particular, we call your attention to the following anti-Second Amendment regulations and policies, which must be immediately rescinded.”

 

The letter then lists the “engaged in the business rule,” by which the ATF sought to expand background checks, the “pistol brace rule,” by which the ATF sought to ban the use of stabilizer braces with AR-pistols, and the so-called “ghost gun” rule, whereby the ATF sought to force background checks for gun parts kits.

 

The Senators also called for the ATF’s “zero tolerance” policy to be halted, a policy which has been used to shut down numerous gun stores over clerical errors on paperwork.

 

Lawrence Keane, senior vice president and general counsel for the National Shooting Sports Foundation, praised the Senators’ letter, saying, “The rules specifically identified by the senators were designed to punish the firearm industry and usher in gun control outside of the legislative process. NSSF has protested these rules ever since they were announced and is heartened that the Trump administration and the Senate are acting quickly to protect Second Amendment rights and the lawful firearm industry.”

Thirty U.S. Senators Want Agency to Begin Rescinding Unconstitutional Biden Rules Immediately

 

WASHINGTON, D.C. – U.S. Senator Cindy Hyde-Smith (R-Miss.) is among 30 Senators who today strongly encouraged the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) to immediately begin rescinding unlawful Biden-era rules that infringe on the Second Amendment rights of law-abiding Americans.

 

The letter, led by U.S. Senator John Cornyn (R-Texas), asserts that the ATF should align its policies with President Trump’s Second Amendment priorities as laid out in his recent Executive Order.  Among other requests, the letter calls on ATF officials to work with Attorney General Pam Bondi to quickly identify and rescind policies that allow unlawful firearms regulations.

 

“We urge you to immediately align ATF’s rules and policies with the President’s strong support for the Second Amendment,” the Senators wrote.

 

“Under former President Joe Biden, ATF adopted numerous policies and rules that infringed upon Americans’ Second Amendment protections.  President Trump’s Executive Order directs Attorney General Pam Bondi to review and develop a plan of action regarding President Biden’s unlawful firearms regulations.  We ask that you work with the Attorney General to quickly identify and rescind these policies,” they continued.

 

The Senators targeted as unlawful the:

  • “Engaged in the Business” rule intended to move the ATF toward imposing universal background checks on law-abiding Americans;
  • “Pistol Brace” rule that improperly reclassified pistols equipped with stabilizing braces as short-barreled rifles, thereby subjecting them to stringent regulations and serious criminal penalties under the National Firearms Act and the Gun Control Act;
  • “Ghost Gun” rule that cracked down on law-abiding hobbyists exercising their Second Amendment rights to privately build firearms, a longstanding tradition dating back to the Colonial Era; and 
  • “Zero Tolerance” policy under which ATF has revoked the licenses of federal firearm licensees (FFLs) over minor bookkeeping violations.

In addition, the Senators request that the ATF immediately destroy the hundreds of millions of ATF Form 4473 firearm transaction records and other licensee records that are over 20 years old, and allow FFLs to also destroy such records.

 

“These records have no particular law enforcement value but do contain the sensitive information of millions of law-abiding gun owners,” the Senators wrote.  “Ending the policy of retaining these very old records will save money for the American taxpayer and counteract ATF’s unconstitutional rule change.”

 

Finally, the letter encouraged ATF to follow a congressional directive for the ATF to improve the archaic National Firearms Act application process in order to make it as efficient as the National Instant Criminal Background Check System.

 

In addition to Hyde-Smith, other cosigners include Senate Majority Leader John Thune (R-S.D.) and U.S. Senators Thom Tillis (R-N.C.), John Barrasso (R-Wyo.), Shelley Moore Capito (R-W.Va.), Jim Justice (R-W.Va.), James Risch (R-Idaho), Cynthia Lummis (R-Wyo.), Steve Daines (R-Mont.), Ted Cruz (R-Texas), Kevin Cramer (R-N.D.), Mike Crapo (R-Idaho), James Lankford (R-Okla.), John Hoeven (R-N.D.), Roger Marshall, M.D. (R-Kan.), Rick Scott (R-Fla.), Lindsey Graham (R-S.C.), Ted Budd (R-N.C.), Bill Hagerty (R-Tenn.), Tim Sheehy (R-Mont.), Pete Ricketts (R-Neb.), Bill Cassidy, M.D. (R-La.), Joni Ernst (R-Iowa), Marsha Blackburn (R-Tenn.), Todd Young (R-Ind.), Markwayne Mullin (R-Okla.), Deb Fischer (R-Neb.), Jim Banks (R-Ind.), and Jerry Moran (R-Kan.).

And we now know how important it is to not have those records just laying about when Soviet, Cuban and Sandinista troops come to Your Town.

2 of those are appointees to fill vacancies,
The 7th has just announced he will not run again, McConnell.

All I know for sure is that the former, anti-gun director appointed by President Biden, resigned rather than letting President Trump fire him.  I  suppose if ATF might be done away with, there'd be no rush to appoint a director.

As far as the ATF going away.... Hmmm If wishes were houses, we would all ride. :)

 

My understanding is that Senate confirmation has been required since 2006. 

 

And yes, Mr. Dettlebach was the second to be so confirmed following a 7 (?) year period with no permanent director.  The director before Dettlebach, B. Todd Jones, served less than 2 years and was nominated by Present Obama.

Rumors seem to be increasingly saying that in addition to heading the FBI, Kash Patel might also head ATF.  The rumors have been out there a week or so but are gaining more traction now.

It's a 4D chess move, if you merge those agencies into a single agency's rule, then Kash Patel already being confirmed can in fact be the director of them all.

CNBC is now reporting that he will be acting director of ATF.  I've heard he's a come and take them kinda' guy.

Always seeming to say what's most politically expedient though. Don't mind me, the guy has always rubbed me the wrong way. 

 

Everything I'm seeing about him is deputy director of the FBI though. Im not seeing any atf headlines.

Yep, I think it shows a clear direction, who knows what will happen with gun control and law enforcement shakeup in the next 4 years but I doubt we are going to see a status quo administration, there is every sign they intend to shake things up and likely in our favor...
