NY police seize E. Jean Carroll's revolver

Police in New York took possession of a gun belonging to writer E. Jean Carroll in February after she said during testimony in her defamation lawsuit against former President Donald Trump that she had an unlicensed firearm at home, according to a police report obtained by NBC News.

The chief of police in Warwick, New York, visited Carroll at her home on Feb. 15 "to discuss some open issues," the report states, including Carroll's disclosure of the handgun while she was on the witness stand Jan. 17.

During the second day of the civil trial, Carroll had told the federal court in lower Manhattan that she kept a "high standard revolver, nine chambers" at home with ammunition. "By my bed," she said.

"I still do not have a license," Carroll added.

John Rader, the reporting officer, said in his report that he "offered to secure the weapon at the police station's property for safekeeping."

Carroll and a member of her security team surrendered the gun a day after Rader visited, and the firearm was being held until Carroll receives a New York pistol license, the report said.

Carroll and an attorney of hers did not immediately respond to requests for comment Friday evening, nor did Rader.

Under New York state law, a person can be found guilty of criminal possession if they possess a firearm, such as a pistol, that has not been registered. The felony carries a maximum sentence of four years.

It was unclear why police waited almost a month to inquire in person about the unregistered gun Carroll said she had at her house or whether police are still in possession of it.

I obviously don't agree with the registration scheme, but the law is the law for now, is she going to be treated differently than others and not charged?  It's clear and obvious it was willful and she was aware it was illegal under the current laws and New York considers it a felony offense, so is she going to be charged or are we going to see another example of our obvious two-tiered justice system?

I agree that the law should be found unconstitutional, but right now it's the law, and just like I feel PICA is entirely unconstitutional as well, I'm currently bound to follow it or face charges, she should be treated just like anyone else violating a law not yet found unconstitutional, especially since they have an under oath self confession of her crime in court...

Can't charge her yet if ever.  Not until the Trump trial is over.  Very suprised they even made this public info. Cause it might have damaged her rep if she was a convicted felon before the trial no?  But just like HUnter this will all be a wash and last years news soon.  Remember when you decide to nor register with Illinois that you can "Be Like Hunter" and just throw them in the garbage dumpsters!

The Track and Recover All Surveilled Human (TRASH) Waste Act will close that loophole by requiring HD cameras be installed on all dumpsters and waste removal vehicles.

That would clearly be too expensive to implement.  They will instead ban purchase, sale, transfer, carry, possession, manufacture, spindling, and mutilation within 3 miles of any trashcan, dustbin, garbage disposal, dumpster, dump, waste management facility or transport, gutter, sewer, storm drain, or manhole.

 

We're not taking anyone's guns away.

It already has been found unconstitutional. If Bruen says you have the RIGHT to carry a handgun outside the home for self defense then it should go without saying that you have the RIGHT to own/carry one in your own home.

Sadly our legal system doesn't work like that, just look at how all the courts are ruling on all these bans across the US even NY's current legislation...

 

Bruen didn't specifically say that NY's registration was unconstitutional, so there is that as well...

 

AGAIN I agree that it's unconstitutional, but sadly our legal system doesn't follow the " it should go without saying" reasoning most of the time and right now NY's law is NY's law and valid until ruled unconstitutional...  Even if we disagree with that logic, that is the logic used by our legal system...
