Taking a break from their main election year concerns about retaining office, those hoping to further ignore the Supreme Court will return to Springfield this week. Never content in their efforts to diminish the Constitution they swore to uphold, several bills posted to the House Judiciary – Criminal Committee hearing 3/5, need our attention. In New York State Rifle & Pistol Association v Bruen the US Supreme Court tells us that laws affecting the Second Amendment are preemptively unconstitutional if no analogous law existed at the time of the founding, circa 1791. Serial numbers were not common on firearms in 1791. They were not required under Federal law until 1968. Yet Representative Croke hopes to increase the penalties for violating an already unconstitutional law from a misdemeanor to a felony, making a person possessing an “unserialized” firearm ineligible to own firearms at all. We oppose HB4550 Crim Cd – Unserialied Firearms, as any freedom loving person should. In DC v Heller, the Supreme Court instructs us that the government may not require firearms be locked away, yet HB5065 Crim Cd – Safe Storage Firearms would require just that.. Yes, there is an exception for a gun in immediate possession, but Heller included no such prerequisite, and there is no analogue in the founding era. In our last alert we spoke of the Bridge Too Far that is the Protect Illinois Communities Act. With his HB5178 Elec Cd – Firearms Polling Place, “Bridge-Too-Far-Bob” Morgan would like to double down on existing law prohibiting firearm possession in “Any building or portion of a building under the control of a unit of local government.” Or, perhaps proposing duplicative law is simply a reminder of his deeply flawed understanding of this subject matter. With HB5442 Firearm Owners ID – Fees, Bridge-Too-Far-Bob seeks to increase the cost of gun licensing in Illinois, a license and fee scheme that can find no historical analogue and is countenanced by no other enumerated right. And, newly appointed Representative Muhl tells us in HB5558 Crim Cd – Lost Firearms that those who's lost gun has been recovered should be fined up to $1,000 and possibly lose their FOID and CCL. During the founding era folks would celebrate getting their lost property back. In today's upside down world, some now see that as reason for punishment. There is a movement among anti-gun forces to abrogate NYSRPA v Bruen's requirement to remain faithful to Constitutional principles. IL doesn't care about them, and just flat out ignores the courts unless there is a penalty, and there isn't one for ignoring bruen apparently or we wouldn't have the ban we are now under.
