John Q Public Posted February 27, 2024 at 09:30 PM Posted February 27, 2024 at 09:30 PM If I was in the store, with the family, I would certainly draw for fear for their/my life. Without the DA doing their jobs, people fear for their lives because these guys just keep coming back. Heck, who knows how many times these guys have been robbed at gun point, or perhaps the store is on the brink and they can no longer feed their family because of this type of crap. THis guy was taking the food from others mouths, while I wouldn't have shot, I certainly am not going to judge. He might have thought there was a gun, he might have been a cowboy, we don't know. The only thing we do know, is the bad guy would not been shot had he not come in to rob the store. We are going to see a lot more of this until we take these guys off the street. People are tired of being victimized by the bad guys and the, "good guys." doing nothing about it.
burningspear Posted February 27, 2024 at 10:22 PM Posted February 27, 2024 at 10:22 PM The offender committed Attempt Robbery. Robbery is a forcible felony. Is Attempt Robbery a forcible felony? I don't know and will not waste my time to figure it out.

An attack on an inanimate object (display case) isn't violence, no matter how strong or frenzied. I'm going to disagree with you. Breaking your neighbors window because you want to break a window is a violent act. A smash and grab is most certainly a violent act. Smash and grab is just a description of a particular form of burglary or robbery. It is a violent act. It is violent. Cheers, Tim
Euler Posted February 28, 2024 at 06:32 AM Author Posted February 28, 2024 at 06:32 AM 720 ILCS 5/2-8 said:"Forcible felony" means treason, first degree murder, second degree murder, predatory criminal sexual assault of a child, aggravated criminal sexual assault, criminal sexual assault, robbery, burglary, residential burglary, aggravated arson, arson, aggravated kidnaping, kidnaping, aggravated battery resulting in great bodily harm or permanent disability or disfigurement and any other felony which involves the use or threat of physical force or violence against any individual. Treason has always had a unique status in American law. Otherwise except for arson (and the inability of IL legislators to spell "kidnapping" correctly), the operative concept in all those crimes is "the use or threat of physical force or violence against any individual," not against property. The federal definition includes manslaughter and mayhem (the attempt or intent to maim), which are also the use of force against people, not property.
TomKoz Posted February 28, 2024 at 12:55 PM Posted February 28, 2024 at 12:55 PM Hmmm 🤔, would legalizing the use of lethal force against those committing “theft”, attempted theft, looting, vandalism, etc. reduce such incidents ??
Jeffrey Posted February 28, 2024 at 03:06 PM Posted February 28, 2024 at 03:06 PM Mutual combat. Thief got a new watch and the store guy got range practice.

How about declaring jaywalking a violent felony? Then we could justify the use of lethal force to stop it, and mikew gets his felony jaywalking dream to come true.

JTHunter Posted February 29, 2024 at 02:57 AM Posted February 29, 2024 at 02:57 AM Lethal force against a perp committing a violent act may prevent any such acts in the future. But, to be truly effective, it must be "irreversible".
Smallbore Posted February 29, 2024 at 02:32 PM Posted February 29, 2024 at 02:32 PM I do not understand ignoring that the salesman's life was threaten by the violent act of the robber. A victim does not have to wait until he is hurt to defend himself. A person walking up to me slamming his fist down on a desk or glass case is a violent threatening act no different than pointing a knife or gun at me. I am a moron not to fear for my life and defend it.
