Using the defense closing arguments as proof of your position?  LOL

 

The 4473 does not ask if you are currently using drugs.  It asks if you are a user of or addicted to drugs.  Even his own words show that this is the case.

Using the argument the defense team made is superior to using ones own thoughts and opinion on the matter.

 

Not that it is at all unclear to me, but there seems to be some arguable leeway in the question... if you gave up drugs yesterday, bought a gun today, and began drugs tomorrow, were you a drug user when you filled out the form?

 

I have no position, although an honest answer seems rather clear to me.

It does not seem so clear to others and may not be at all clear to a jury.

The better way to phrase it would be "Did you believe that you were a drug user?"

Perhaps to someone who has no common sense and is comfortable with a lying / grifter family in the White House.  I think the rest of us know that liars...  err..  lawyers lie.

Clearly shows that you are addicted..  which is the other part of that question on the 4473.  I think that any reasonable person would agree that "the smartest man that Joe knows" is a drug addict.  There is an overwhelming amount of evidence that shows this.

As I said, the question is not unclear to me. If using drugs of any kind, including Illinois legal recreational or medical weed, you must answer yes to that drug question. It is possible now that the NRA, SAF and other pro gun organizations will weigh in on the question. The question is already in the courts. 
 

The jury found a correct legal answer, the same as mine. When drug use is OK for owning or buying a gun, I will still not be a drug user. Some members here and across the country will continue using drugs of all kinds. 
 

RE your first comment about being OK with grifters in the White House… glass houses my friend.

Joe Biden will use this to claim virtue about being fair and just. "Look, even my own kid was found guilty, so I don't want to hear about 2 tier justice."

Then when no one is looking, he will pardon the smartest person he has ever known. Fact is, this case was cut & dry and anyone breathing could understand the charges, trial and verdict.

He won't pardon him. The justice department will get him a slap on the wrist and a future administration will pardon or expunge this as politically motivated.

What cracks me up is 80% of his platform is basically what rust belt union Democrats have wanted for decades. Unfortunately a bunch of bobbing headed propagandists on TV somehow convinced 30% of the country that they were about to be thrown into a concentration camp.

He does have a clean record first time offender same as someone who checked no box but had a cannabis license even if they may have never used any.

The real test of this is in the sentencing. Will he be sentenced just as any ordinary citizen would or will he get special treatment? Is he held in jail until sentencing or out on HOR until then? IF out  on HOR does he stick around or head for Dubai?

Under similar circumstances, an ordinary citizen would not have been indicted.

I wouldn't want to test that theory. At a minimum, your days own owning/carrying a weapon might be over.

Technically this is his first GUN conviction.

Technically the tax issue would be his FIRST TAX issue.

Ordinary circumstances normally don't include prosecution of a lesser crime to pull attention away from a major crime like tax evasion.  But let's face it, we all knew this was (D)ifferent.

Federal sentencing guidelines will play into this -- establishing a sentencing range for the judge to consider that is based on offense severity, offender criminal history, and other such factors.

You can expect the defense to argue for the lower end of the range, and the prosecution for the higher end of the range.

That's a pretty steep penalty for exercising a constitutional right.
