UPDATE(S):

 

Senate Amendment 1 has been filed on SB424 Criminal Law - Tech

 

Replaces everything after the enacting clause. Amends the Firearms Restraining Order Act. Expands the definition of "petitioner" to include intimate partners. Amends the Unified Code of Corrections. Eliminates the repeal date of the statute creating the First Time Weapon Offender Program. Changes the name of the Program to the First Time Weapon Offense Program. Deletes a provision that a defendant is not eligible for the Program if he or she is 21 years of age or older. Provides that the Program shall be at least 6 (rather than 18) months and not to exceed 18 (rather than 24) months. Makes other changes regarding the conditions of the Program. Effective July 1, 2023.

Although last Friday was initially scheduled as the final day of Spring Session the amount of unfinished business, including a budget, brings the legislature back to Springfield this week.  As it stands at this moment, the Senate plans session today and Thursday.  The House intends to be in session today, Thursday and Friday.

 

When they were last in sesssion, the Senate abopted SJR40 Gun Violence Prevention Week. We add this to the House calendar today.
 
 

The House is scheduled for 11:00 AM today;  the Senate for 1:00 PM.

Declares July 2 through July 8, 2023 as Gun Violence Memorial and Prevention Week. Mourns the lives lost at the hands of gunfire in the City of Highland Park on July 4, 2022 and all those around the State of Illinois who have been lost to gun violence and recognizes the surviving families that live with the trauma of their losses. Remembers the lives of Katherine Goldstein, Irina McCarthy, Kevin McCarthy, Stephen Straus, Jacquelyn Sundheim, Nicholas Toledo-Zaragoza, Eduardo Uvaldo, and Aréanah Preston. Remembers all gun violence victims in the City of Chicago and all gun violence victim everywhere across the State. Honors the City of Highland Park, the City of Chicago, and their law enforcement, first responders, and community leaders for their service to the people of Illinois. Urges leaders to continue to do everything in their power to ensure communities across the State do not experience the trauma of gun violence, so that these horrific tragedies shall not be in vain.

Amends the Illinois Governmental Ethics Act. Makes a technical change in a Section concerning the short title.

Replaces everything after the enacting clause. Amends the Criminal Code of 2012. Provides that the prohibition on possession of an assault weapon, assault weapon attachment, .50 caliber rifle, or .50 caliber cartridge device does not apply to a person who lawfully possessed that assault weapon, assault weapon attachment, .50 caliber rifle, or .50 caliber cartridge, if the person, in addition to other requirements, has provided to the Illinois State Police in an endorsement affidavit, prior to January 1, 2024, under oath or affirmation, in the form and manner prescribed by the Illinois State Police, an affirmation that the affiant possessed an assault weapon, assault weapon attachment, .50 caliber rifle, or .50 caliber cartridge on or after the effective date of Public Act 102-1116 based upon a preliminary injunction or restraining order issued by a court in the State. SB424 Criminal Law - Tech has been assigned to the Senate Executive Committee and a hearing is just wrapping up.

 

With encouragement from the chair to continue discussions on this which she correctly says has many questions to be addressed, the bill is reported to the floor on a vote of 8/4/0.

 

Round one of Senate Executive has adjourned.
