Important Legislative Update

Published: Fri, 04/07/23

                                       Important Legislative Update

We want to alert you to two important items.

On April 10, 2023, police will be enforcing the new Illinois law 720 ILCS 5/24-1.9(d) that states in part:

Beginning 90 days after the effective date of this amendatory Act of the 102nd General Assembly [January 10, 2023, so beginning April 10, 2023], a person authorized under this Section to possess an assault weapon, assault weapon attachment, .50 caliber rifle, or .50 caliber cartridge shall possess such items only:

(1) on private property owned or immediately controlled by the person;

(2) on private property that is not open to the public with the express permission of the person who owns or immediately controls such property;

(3) while on the premises of a licensed firearms dealer or gunsmith for the purpose of lawful repair;

(4) while engaged in the legal use of the assault weapon, assault weapon attachment, .50 caliber rifle, or .50 caliber cartridge at a properly licensed firing range or sport shooting competition venue; or

(5) while traveling to or from these locations, provided that the assault weapon, assault weapon attachment, or .50 caliber rifle is unloaded and the assault weapon, assault weapon attachment, .50 caliber rifle, or .50 caliber cartridge is enclosed in a case, firearm carrying box, shipping box, or other container.

The first violation is a Class A misdemeanor, while a second or subsequent violation is a Class 3 felony.

In addition, on April 122023, there is a hearing in the U.S. District Court, Southern Division, on the lawsuit.

Please share with others and remind them that the ISRA is the leader in supporting our 2nd Amendment rights.

Sincerely,

“4) while engaged in the legal use of the assault weapon, assault weapon attachment, .50 caliber rifle, or .50 caliber cartridge at a properly licensed firing range or sport shooting competition venue; or”

If the range is located outside Illinois why would it matter with regard to licensing or competition?

Is the ISP going to give notice to all FOID holders about some special law thing coming up?
I haven’t heard from any State Agencies about new laws.

That's rich.

Does the PICA have any mandate for the ISP to do any notifications?

I guess we are supposed to feel fortunate that they made a FAQ and put it on the ISP.illness.GOV pages instead of ISPFSB.com.

Hopefully the court puts the brakes on this whole mess long before October. Hopefully the FOID card is slapped down by then too.

They won’t give up the FOID without the US SC telling them to get rid of it.
When in our text, history, and tradition have we ever required state issued documents granting you RIGHTS to your rights?

We have to pass a test to use our 2A along with a small tax.  Put that on the 1A and every anti 2A will quickly change tune.
