IL - U.S.District Court, N.D. -  Bevis v. City of Naperville - Appeal filed in U.S. 7th Appellate Court 3/7/2023 and motion filed for preliminary injunction.

 

IL - U.S. District Court, N.D. Illinois  - Kenneally v. Raoul Motion for summary judgement filed by the state 03/03/2023.

 

IL - U.S. District Court, E.D, - Herrera v Raoul Motion hearing held. Motion for TRO and preliminary injunction 4 is taken under advisement. Mailed notice. (jlj, ) (Entered: 04/17/2023)

 

IL - Illinois Appellate Court 5th District - Accuracy Firearms, et al v Pritzker Defendant's Motion to Stay Proceedings, and Defendant's Motion to Dismiss set 3/21/23 10AM.

 

IL- 6th Circuit Court District -  Caulkins v Prizker State filed appeal to Illinois Supreme Court 3/3/2023.

Only the motion for preliminary injunction is in the appellate court. The rest of the case is still in the district court.

 

EDIT: Not anymore. The preliminary injunction was just denied. It's all in the district court now, unless Bevis petitions the US Supreme Court.

SCOTUS is declining to intervene at this time on the lack of a Preliminary Injunction in the Bevis v Naperville case.

 

The normal course of the cases continues:

  • 7th Circuit Court of Appeals hearings on the Preliminary Injunction and stay thereof continues.
  • The District court proceedings on the merits of the case continue which could end up in Dismissals or Permanent Injunctions
  • After those District courts are done, they will be appealed to the 7th Circuit which will likely hold hearings and issue rulings on the final disposition of the cases.
  • After the 7th Circuit handles (or denies to hear) that appeal, it will likely be appealed back to SCOTUS
  • SCOTUS may or may not accept that appeal.

Which will take years to get done with the state asking for continuances after continuances all the time our rights being denied! AND the state is using OUR money to screw us over.

One thing I keep losing the thread on is whether those district court proceedings are all now consolidated and if so, to which court and on what schedule.  Do we have definitive information on that, at this point?

The 4 Southern District cases are consolidated with each other at the district level.

The Naperville case is separate at the district level.

The other Northern district case with the doctor is separate at the district level.

 

You can check the dockets on the various threads for the latest scheduling information.

We got a expedited hearing in the Barnett case at the Seventh Circuit. No continuances, everything must be in at three specific points in June, with a hearing at the end of the month.

Kenneally isn't consolidated with anything.

 

Herrera, Barnett, and Bevis are consolidated for the preliminary injunction appeal. They are still separate cases at the district level.
