Yanas v Pagourtzis (and Lucky Gunner) - Santa Fe, TX shooting

In May 2018, three families (Yanas, Yarbrough, and Tisdale) filed three separate civil suits against Dimitrios Pagourtzis (the perpetrator of a mass shooting at Santa Fe High School) and his parents in Galveston County civil court. (Three separate mental health professionals have found Dimitrios Pagourtzis not mentally competent to stand for a criminal trial. Every 12 months since then, other examiners have found the same. He continues to remain in custody at a mental health facility.)

 

In March 2020, the suits added, as defendants, the FFL that sold Pagourtzis the firearm, Lucky Gunner (which sold him the ammunition), and a few related parties. The complaint against Lucky Gunner was based on the fact that it sold ammunition to someone under the age of 18. (Pagourtzis was 17 at the time.) Texas did not (at the time) have a law prohibiting the sale of ammunition to people under 18.

 

In May 2020, Lucky Gunner tried to remove the suits to the Federal District Court of Southern Texas. In December, the federal court remanded the cases back to Galveston County court.

 

In February 2021, the Galveston County court consolidated all three cases as Yanas v Pagourtzis (CV-81158).

 

On January 30, 2023, the plaintiffs notified the court that they had reached a confidential settlement with the defendants.

 

On February 9, the court ordered the case dismissed with prejudice on the basis of the settlement, each party to pay its own legal expenses.

 

Lucky Gunner released a public statement.

We are thankful the truth is finally out, even if most in the legacy media have wrongly painted this to be a groundbreaking win for anti-Second Amendment activists. That simply isn’t true. We agreed to continue with the same age verification process we have been using since 2019. We did not agree to change any part of our business as a part of the resolution of this lawsuit.
