I am a U.S. veteran, and have never been court ordered, institutionalized, or hospitalized due to mental health. The application questions are so broad. I answered yes, as I do see my family physician for anxiety. However, I should not have been denied as they gave me no opportunity to clarify my answer. I missed the 60 day appeal, and am now reading Illinois is putting together a board to handle appeals? Can anybody offer any advice as to how to go about getting this decision overturned? Back when I originally applied, I was reading the wait could take years. This was a complete misunderstanding and should have never been denied. Is the process to appeal any faster now? Revocation Reasons and Appeal Options under "State Prohibitor - YES Answer" (emphasis added): ISP said: State Prohibitor - YES Answer You answered "Yes" to one of the questions pertaining to your ability to possess firearms. Appeal Options Pursuant to 430 ILCS 65/10 and 20 Illinois Administrative Code 1230.70, you may appeal to the Director of the Illinois State Police (ISP). To appeal you must submit a Request for FOID Appeal, a Request for Investigation and Waiver of Liability and all required documentation as listed in FOID Appeal Requirements instruction sheet. If your "Yes" answer was inadvertent, also complete an Inadvertent Yes Answer Affidavit(s) providing an explanation for your "Yes" answer. To obtain the appropriate affidavit please call the Customer Service Call Center at the number listed below. If, however, your "Yes" answer was correct, you must provide an explanation and, where applicable, supporting documentation as listed in FOID Appeal Requirements instruction sheet. A Request for FOID Appeal, a Request for Investigation and Waiver of Liability and instructions are enclosed and are available in the FOID Appeals FAQs on the ISP website, www.isp.state.il.us or by calling the Customer Service Call Center. I don't recommend trying to call. You'll never get a live human or even a robot who can send you a form. The email address in the "Contact us" section of the ISP website is ISP.AskFOIDandCCL@illinois.gov for questions. I believe the "Inadvertent Yes" form you need is this pdf, but ISP didn't make it easy to find, so I'm not certain it's current. I've never been through it. Perhaps others will post who have.
