All we can do is take it up the ladder and have the superior courts continue to slap the inferior courts around and tell them they are wrong until they 'get it'

Dumak_from_arfcom Posted March 28, 2023 at 01:34 AM Posted March 28, 2023 at 01:34 AM It looks to me like they have decided on what they feel will be their best legal theory going forward. The second amendment only protects muskets. And they have deliberately misinterpreted Bruen to back up their argument. They can't provide any historic analogs so they have made no analogs as an analog in itself. Since the guns weren't in common use in 1791 they are not protected by Bruen or Heller today, so they can interest balance. It is a complete deliberate bastardization of both decisions. That is how the left leaning judges and courts will rule from here on out. They are refusing to bend the knee.

Thomas and Alito are old, and I'm not sure GOP is better than 50/50 at this point to win in 2024.

The good thing is that as a general rule the Supreme Court is very reluctant to overturn it's own precedent, especially wihting a short period of time, and when it comes to enumerated rights, the Supreme Court has generally expanded those rights when it does overturn itself. As an already clearly divided nation with a division growing, I honeslty fear a Supreme Court overturning Heller/Bruen.

If lower courts see that SCOTUS isn't a conservative majority, they can just ignore Bruen. I really wish some of these things would speed up.
John Q Public Posted March 28, 2023 at 09:33 PM Posted March 28, 2023 at 09:33 PM Okay, I think a point has been missed, forget the foreskin/stock, the 10/22 can/does accept a magazine... therefore, we need not go to the stock/shrouds, but they would be banned as, "detachable magazine." If I had a non detach, cool, but most now have a mag, rotating, or otherwise. JQ

Yeah what’s frustrating is that scotus had the chance to take Bianchi right after Bruen and settle the gun ban issue but chose instead to GVR and punt it so the lower courts could come up with new games to subvert the Bruen test. Thomas and Alito must be more confident about their personal health and wellness than I am to let these core issues bounce back for a few years in the same courts that flagrantly ignored Heller.
JTHunter Posted March 31, 2023 at 02:53 AM Posted March 31, 2023 at 02:53 AM Todd, Your two videos in this thread were such that I put links to them in a couple of other forums I frequent. I hope you don't mind but you were so explicit and pithy in your comments, I got a laugh out of it watching you poke holes in the politicians and wanted to let others that might not come to Illinois Carry know what is happening.

As I mentioned in another thread I was waiting for the most egregious parts of these laws to become more public. There are a lot of FUD shotgun owners, and that's all they own, who can live their life ignoring the 2nd amendment fight because the laws never or rarely affect them. IMO, a short sighted stance to take because we all know they will never stop, the shotgun owners were just last in line but in the line, nevertheless. Well, it's the end of the line now! The more ridiculous this law is and the more people it affects, the better off we are. More grass roots support, more funding for lawsuits, and more likely to win in court.
RECarry Posted April 8, 2023 at 12:47 PM Posted April 8, 2023 at 12:47 PM After successfully sending some prior videos to friends, Hotmail rejected my latest send to about 16 people on Thursday. Censorship? Basic spam filter stuff?

Censorship? Basic spam filter stuff? Ask hotmail? perhaps review your technique first. Service providers that provide your email for "free" can set whatever terms they want. Recipients or their "free" providers can cry abuse whenever they want. Did you send an attached video? Or a link to a video? Some videos can be quite large Did you send to a blind list of recipients, or are you sending the addresses in the clear? People tend to not like seeing themselves name in a big list of other names and addresses. How often are you sending such a message? Do you think that everyone on your list wants to be there? You must honor a request to be removed from the mailings.

I'm guessing the number of people (same email) and it being a video (likely no actual email body content) might have triggered the spam setting, especially if this varies from your normal use.
RECarry Posted April 8, 2023 at 11:35 PM Posted April 8, 2023 at 11:35 PM Update: It's a blind list of recipients to friends who do like the notifications and witness slip alerts. It was a video link, not an attachment. An IT friend discovered that Hotmail identified a problem with their outgoing spam filter on Thursday April 6th that disrupted an untold number of outgoing emails. This morning my Junk folder started populating with tardy "undeliverable" messages from April 6th, but most of the ones our family sent that evening were delivered as well. The odd part is that our Sent folders showed all those messages as Sent, not bounce-backs when the problem was occurring.
ILgunguy Posted April 9, 2023 at 08:32 PM Posted April 9, 2023 at 08:32 PM (edited) I've noticed that there has been no clarification like JB put out when we all had to wear masks during the Covid declaration to keep the ISP and DA's from charging otherwise lawful carriers. This tells you a lot. So....just quit carrying any semi-auto until/if this stupid law gets an injunction? Edited April 9, 2023 at 08:32 PM by ILgunguy

JTHunter Posted April 10, 2023 at 03:02 AM Posted April 10, 2023 at 03:02 AM I have posted Todd's videos in three other forums I frequent. It has definitely raised the ire of some in those forums, both for the stupidity of the ILGA and the vague broadness of the language in the law.
