I personally thing the 7th knows they will be walking on thin ice if they overturn the stay, McGlynn didn't just knee-jerk issue a stay, he detailed multiple (and very solid) reasons for his stay. Of course the 7th could entirely dismiss all those reasons, but I think they are aware that might leave them eating crow sooner than later. Of course all that said, I would not hold my breath on the 7th doing the right thing, even when they know it's the right thing and I fully believe we will need a 3rd or even 4th Supreme Court case for the thick headed lower courts to finally understand the 2nd is a right that they can't deny over feelings and emotions. They didn't mention anything about the other judge issuing the tro state wide! SO what the heck is going on????? The Federal Rules of Civil Procedure require plaintiffs to ask a district judge to reconsider before they appeal a denial. I don't believe the Rules require defendants to ask a district judge to reconsider a grant. For example, CA has certainly appealed lots of Judge Benitez's injunctions. Swung by my local Rural King - corporate store, not a franchise store. Lots of MSR’s on racks, lots of 30 round mags on shelves. I’d have thought they would have pulled all stock back to corporate for redistribution to stores that could actually sell it rather than just have it collect dust taking up room in stockroom. Likely too much hassle and logistics with diminished returns vs just tucking them in the corner it the back of the building and seeing what happens, especially for the firearms that would need the hassle of FFL bookeeping to transfer out of state. The amount of out right lies in the request to stay the injunction is staggering, but not unexpected. And it's not McGlynn's fault that other judges can't or won't apply Heller and Bruen appropriately. And if this is appeal to McGlynn, the state basically saying "you're stupid, and don't know the law" won't go over well.
