On Tuesday morning, former Illinois Republican nominee for Attorney General Thomas DeVore filed a lawsuit in Effingham County against Gov. JB Pritzker, State Senate President Don Harmon, D, Illinois House Speaker Christopher Welch, D, and Attorney General Kwame Raoul, D, in response to the assault weapons ban that Pritzker signed into law last week.

An emergency hearing is scheduled for 11:00 am CST tomorrow in Effingham County where DeVore will be seeking a temporary restraining order to restore the constitutional right to bear arms while this matter proceeds through the courts. Links of the documents filed, and shared exclusively with Illinois Review, are included below.

Assuming that is granted, does that TRO only apply to Effingham county?

Probably 4th judicial circuit if I’m not mistaken.

edit: individuals from 87 counties are involved i guess per the press release of the lawsuit and this:

The dems really are breaking rules.

The problem is that courts really aren't interested in getting involved in the legislative process.  They view it as separation of powers.  The judicial process is the court's business and Legislative process is the business of the Legislature.

My question is how far are the courts going to allow it to go.

Statement from accuracy firearms:

We would like to say thank you for all the support over the years and especially the last few weeks! This was not something we ever thought we would have to do. However, we believe what we did was right. Both sides have argued the case and the Judge has advised we will have a ruling by Friday. Once we know what the ruling is we will let everyone know! Thanks again for all the support as we fight for our constitutional rights!

Special thanks to Thomas DeVore Blaine Wilhour Darren Bailey State Representative Adam Niemerg for coming out in support!

Sincerely,
Accuracy Firearms

Just read that last night Raoul asked for a delay and a different judge than Miller. I guess he was scared Miller will not rule his way. The chief judge gave a substitute but not a delay.

"Sources confirmed to Illinois Review that late last night, Attorney General Kwame Raoul’s office attempted to delay the hearing by seeking substitution of assigned Judge Chad Miller. In response, Chief Judge Douglas Jarman reassigned the case to Judge Morrison, and the hearing proceeded as scheduled."

Here’s the judge when he was a SA. Appears to lean definitely more on freedom vs government orders and bs laws/overreach:

https://southernillinoisnow.com/2022/03/04/fayette-county-states-attorney-joshua-morrison-announces-his-candidacy-for-circuit-judge/

State’s Attorney Morrison was among the first State’s Attorneys to condemn Governor Pritzker’s COVID mandates and protect individuals’ rights by directing law enforcement within the Fayette County to follow the law as it was written and not issue citations for mask mandate violations or businesses being open in defiance of Pritzker’s closures. He has worked closely with businesses and the Fayette County Health Department to ensure that Fayette County has stayed as open as possible through the pandemic.
