South Side 27 Posted January 17, 2023 at 06:50 PM Posted January 17, 2023 at 06:50 PM Just saw this over on the commie Crap Fax blog. Anyone know anything about this filing by what looks like 3 individuals? COMPLAINT.pdf
ILgunguy Posted January 17, 2023 at 06:59 PM Posted January 17, 2023 at 06:59 PM Just saw it as well. My question is what does this do to the 3-pronged approach we have already heard about? Is this part of it? Is it premature?
mauserme Posted January 17, 2023 at 06:59 PM Posted January 17, 2023 at 06:59 PM Thanks for posting this. I updated the title to better identify the suit, and moved it to the Judicial forum.

This is one of many such actions we can anticipate.
Benbow Posted January 17, 2023 at 07:25 PM Posted January 17, 2023 at 07:25 PM its hardly premature. For the most part, you cannot buy an AR15 spring in this state, wholesalers won't sell an AR bolt to IL, and subject to those with still open FTIPs, you cannot legally acquire an Ar rifle in this state. Its timely. What I want to know, is why this is the first. With all the money some people are collecting to file a lawsuit of this type, why is this the first?

This is the first because it reads like a complaint written by an attorney who really wanted to be the first to file. I spend a lot of time reading court documents professionally and out of personal interest. I wouldn't be happy if one of my attorneys wrote this.

Benbow Posted January 17, 2023 at 09:02 PM Posted January 17, 2023 at 09:02 PM Well, I spend a lot of time WRITING court documents, which of course is much harder than just reading them. If you have a substantive criticism that you can articulate, perhaps you can articulate it
steveTA84 Posted January 17, 2023 at 09:55 PM Posted January 17, 2023 at 09:55 PM Keep in mind too that this is T DeVore’s are both in state court. The big ones are going to be filed in Federal court
Steve51 Posted January 17, 2023 at 10:17 PM Posted January 17, 2023 at 10:17 PM Just received an email from ISRA. It says they are filing a Federal lawsuit imminently (whatever that means).
mab22 Posted January 18, 2023 at 02:45 AM Posted January 18, 2023 at 02:45 AM Why didn’t they include the FOID? If your going to complain about the restrictions of certain weapons, the FOID prevents you from even possessing or purchasing ANY firearm OR ammunition even for something in the HOME. I would think a FOID challenge should be relatively easy after Bruen?

steveTA84 Posted January 24, 2023 at 09:06 PM Posted January 24, 2023 at 09:06 PM Also, the federal judge is the same one who ruled on felons and guns not too long ago, ruling some felons do not lose their 2A rights https://www.thetruthaboutguns.com/u-s-district-court-some-felons-do-have-second-amendment-rights/

Upholder Posted January 25, 2023 at 02:55 AM Posted January 25, 2023 at 02:55 AM Motion for Preliminary Injunction: https://storage.courtlistener.com/recap/gov.uscourts.ilsd.94440/gov.uscourts.ilsd.94440.6.0.pdf
Upholder Posted January 25, 2023 at 03:00 AM Posted January 25, 2023 at 03:00 AM Quote Plaintiffs seek, at this juncture, a preliminary injunction. Defendants, at this juncture, have been formally served. Defendant Kelly has filed a Notice of Removal, and clearly has notice of this file. In fact, on the morning that this motion was filed, the undersigned personally advised one of the attorneys in the Illinois Attorney General’s Office, who represented that she was assigned to work on this case, that this motion was being filed. At a minimum, they are actually aware of this lawsuit. In fact, Defendant Shaner personally called the undersigned on the phone, and mentioned his unhappiness with this lawsuit. I'm not sure that the defendant calling the plaintiffs to whine is a winning legal strategy... but it made me chuckle.

Isn’t the Crawford SA who’s getting sued one of the “good guys”? If so, I get where he’s coming from. Still funny though

That happens sometimes. in ISRA v Madigan, the ISP director was a friendly, but was named in the suit in his official capacity. (this was to keep John O'Connor and the Associated Press from getting your FOID info.)
steveTA84 Posted January 25, 2023 at 06:34 PM Posted January 25, 2023 at 06:34 PM Judge assigned is an Obama appointee On the bright side, the other two federal cases (the big ones) have a judge that is not anti-2A (on paper at least)
