FOID denied at 18, appealed at 21. Waiting 5 months, is there anything I can do?

Recommended Posts

I was denied my FOID card when I was 18 years old. The reason for this denial was that my mother, who had to sign as my "sponsor" since I was under 21, was unknowingly ineligible to possess an FOID card of her own. I emailed and called the ISP multiple times over the next 3 years asking what I could do without hearing anything back, until my final attempt at communication right before I turned 21. The person who responded instructed me to reply with appeal documents when I turned 21. I emailed the requested documents and have trying to wait patiently even though I feel like this should be a pretty quick consideration. It's been 5 months and the ISP does not respond to my emails regarding my appeal. I have no criminal record, have never been institutionalized, and no longer have any legitimate reason to be denied. Is there anything I can/should do here? Or do I just have to suck it up and wait for the ISP to decide I'm worthy of my constitutional rights?

Any input would be appreciated. Thank you

Have you tried just applying normally again after you turned 21?

Now that you can apply without a sponsor, there really is nothing to appeal. Unless the ISP throws every denied applicant into the "DENY FOREVER UNTIL THEY APPEAL" bin, which they totally might do, you should be able to get one. Your application sounds like it should have been rejected, not full blown denied.

There's typically only one FOID application per person, unless the FOID expires. Denied usually does mean denied forever, at least until appeal.

I don't know what the ISP does when an applicant goes from minor to adult, though, if anything. I don't believe that condition applies here, anyway. Plus the OP has already submitted an appeal.

I suggest logging in to the ISP site and seeing if it reports a status. As long as it's under review, I'm pretty sure there's no way to speed it up.

Yep, I've tried this a couple times. It just pulls up my original account/application information with a red "Denied" next to it. I completely agree that there is nothing here that I should have to appeal for, but that's what they wanted me to do. I guess I'm just dead in the water waiting for a miracle here

When I try to log in under the original account it doesn't let me in, but does tell me that I'm under review with a pop-up. This is what I've been seeing for the past 5 months and it's getting a little old for a situation that seems very cut and dry to me. Very frustrating

Try applying again on a new account.
