Call to Action 12/11/2022 – Witness Slips Needed!

 

In our last Call to Action, we outlined the myriad ways HB5855 Firearm – Assault/FOID/Restrain has already been found unconstitutional. The US Supreme Court reversed several lower court orders that had upheld many of the provisions in this bill, remanding them for consideration under the provisions of New York State Rifle and Pistol Association v Bruen. They've also strongly suggested other provisions are a SCOTUS ruling away from the same fate.

 

Yet Representative Morgan persists in his fool's errand, scheduling hearing after hearing, searching for a chink in our Second Amendment armor.

 

When we last asked for witness slips opposing this bill, it was with the advice that your help would be needed again. That time has come.

 

Step 1: Please show your renewed opposition to the infringements in this bill by filing new witness slips for the 12/15/2022, hearing.

 

Step 2: If you have not already done so, file an additional slip opposing this bill in the 12/12/2022, hearing.

 

Step 3: Stay prepared to file slips in at least one, or possibly more hearings in the coming days.

At what point does it become a “deprivation of rights under the color of law”?

  • Section 242 of Title 18 makes it a crime for a person acting under color of any law to willfully deprive a person of a right or privilege protected by the Constitution or laws of the United States.

    For the purpose of Section 242, acts under "color of law" include acts not only done by federal, state, or local officials within their lawful authority, but also acts done beyond the bounds of that official's lawful authority, if the acts are done while the official is purporting to or pretending to act in the performance of his/her official duties. Persons acting under color of law within the meaning of this statute include police officers, prisons guards and other law enforcement officials, as well as judges, care providers in public health facilities, and others who are acting as public officials. It is not necessary that the crime be motivated by animus toward the race, color, religion, sex, handicap, familial status or national origin of the victim.

    The offense is punishable by a range of imprisonment up to a life term, or the death penalty, depending upon the circumstances of the crime, and the resulting injury, if any.

TITLE 18, U.S.C., SECTION 242 

Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, ... shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

That is federal. Wouldn't a federal prosecutor have to charge them?   That won't happen under this DOJ.

It's a legislator's job to pass laws. Laws are presumptively constitutional when passed. Therefore legislators cannot be arrested for passing laws. Also, since arrest is an executive power, arresting legislators for passing laws would itself violate the Constitution.

 

Deprivation of rights under color of law is when a person, usually a cop -- but not necessarily even a government employee, asserts as legal an authority he doesn't have to force you to do something, like enter your home, provide personal information, etc.

It does. I have seen it before. If they have more than us, the rep will parade it out that they have the support of Illinois. If we outnumber them, they ignore it. Just gives them one less stat to use against us.
