FOID “Modernization” Signed Into Law


Despite the strong opposition of IllinoisCarry and other right minded gun rights groups who continue their support of the Second Amendment, HB562 was passed by the legislature in June of this year with the help of the Illinois State Rifle Association. It has now been signed into law by Governor Pritzker. It is a sad reflection of how bad things have become in Illinois when one of our own state organizations would work to pass this legislation, which includes registration of private firearm transfers!

Now known as Public Act 102-0237, most of this new law will take effect January 1, 2022; a few provisions will not take effect until 2024.

Some might argue that this is a good law, pointing to the fact that hunters will be able to carry concealed while hunting. While it is true that those hunters who wish to arm themselves with a concealable firearm in addition to their bow, shotgun, or hunting handgun will now be able to do so, it is equally true that no one claiming to support the Second Amendment would willingly trade this for the creation of a gun registration scheme. Yet, the ISRA felt this legislation was not worth fighting against, remaining neutral and making that exact trade because the law requires that all private sales info (make, model & serial number) must be reported to an FFL dealer. That dealer is to keep the record on file for 20 years in addition to collecting a burdensome fee of as much as $25.


The new law also creates a governor appointed review board, with no standard of legal review, who will decide by majority vote whether or not FOID appeals are granted approval. This will not serve those who are denied their rights under the Act, who insist that their Second Amendment rights are every bit as important as their more politically correct rights.

Also troubling is the first introduction of fingerprints for a FOID card. While it is voluntary at this time, it will now be a much easier step to make them mandatory in the near future.

Some argue that making it easier, more efficient to infringe on our rights with this thing called FOID “Modernization” was a desirable goal. Those truly in support of our rights would not seek compromise for “a place at the table”. Not this compromise. True gun rights supporters would not have walked away from the cause. True gun rights supporters continue to say VOID THE FOID!
