I love this crap. First, they unconstituionally ban you from owning a semi-automatic rifle. But ... they (the ATF) flat out state that pistols are legal. Pistols are regulated by the state, so Crook County can't keep you from buying one. So, you follow the unconstitutional law that forbids you from owning a semiautomatic rifle by buying a pistol, THEN they want to declare that illegal and put you in jail unless you give it up.

 

All in violation of the 2nd and 5th Amendments, as well as the provision against ex post facto laws. Yet, liberal activist judges invent "constitutional rights" out of whole cloth: abortion, gay marriage, etc. Thank you Democrats and indoctrinated young know it alls who can't remember a time before you could be brainwashed over the internet.

 

The Left were patient. They planted themselves into higher "education" until the controlled it, then moved down into the PUBLIC high schools and grammar schools. They were actually paid to use OUR money to indoctrinate OUR children. And they are winning.

This topic is about Biden's potential actions to infringe our rights. If Biden has indeed won the election Trump firing the director of the ATF, or not, will have no effect on Biden's stated goals or his ability to accomplish those goals.

 

The only way we can protect our rights is to look forward to the threats Biden has clearly stated. Backward looking, deflecting from the real problem in other words, does not help anything.

Roberts, no way. Gorsuch, who really knows yet?

 

What we can say is that with the current Court, the 2A stands a better chance of survival that it has in a long time. However disappointed I may be in the results of this election, assuming Biden turns out to be deemed to have won it, it's clear that all the work that went into making the last four years happen was definitely worth it. And we've still got a good chance of getting a Senate which will give us a shot at keeping the next occupant of the White House from making matters worse.

Trump has removed plenty of department heads for going behind his back. If they truly did that here (which I find a dubious claim at best) then he is well within his power to act on it and remove the person responsible.

If Biden becomes President, removing the head of the ATF will be pointless. If Biden does not become President, removing the ATF head will be unnecessary.

A pistol brace ban isnt that far of a stretch of the imagination.... theyve already drawn a small line in the sane with braces.... and theyve appeared eager to ban them entirely for quite some time with their flip flopping back and forth trying to skirt the edges

 

80% lowers is a totally different subject....... they can never stop "ghost guns"...... the cat is out of the bag

I agree with this, but there has to be a point drawn between square cut billet block and firearm, that line right now is coined 'an 80%' but IMO there is no way they can lower that line all the way down to square cut billet block, the best they can do is move it slightly and with desktop CNC a reality, as you said the notion they can ban and stop them is plain stupidity. There are kids in the jungles of the Philippines welding together literal scrap metal in shacks with mostly hand tools into 1911's and other guns that are fully functional and look factory made, there are dozens of garage based machine shops churning out a plethora of other fully functional clone firearms in the Philippines. Ban todays 80% paperweights and tomorrow there will be 70% paperweights on the market.

 

But, I'm of the opinion the Supreme Court needs to put an end to these attempts to stop people from exercising their right individually and forcing them to be dependent upon exercising that right with only commercial offerings the government approves.

Just remember what happened when the Canadians required long gun registration. It cost 10 times what it was supposed to, no crimes were solved with it, people were sending in registration forms for dead people with guns that didn't exist, apparently by the tens of thousands, and it became so bad, they just scrapped it.

 

Now imagine, a NFA registry that, all of the sudden, doubled in size overnight (read Brace equipped guns are NFA and there is an "Amnesty" for same, or increased by TEN times overnight (read, semi auto's reclassified as NFA and there is an amnesty). Granted, based on historical examples, such as California, Illinois (yes, Illinois at one time had some gun registration, which was scrapped due to non-compliance), New York, CT, etc, I would expect about 20 to 25% compliance, and the rest giving a big middle finger, until one thing or the other happened. Either, the govt just gives up, be it a SCOTUS loss, change of admins and repeal, or whathaveyou, or, the feds get really serious, and your grandkids look at an AR like you do a 1928 Thomspson SMG, and your scared to be in the same room with it, for fear of ATF agents in the closet, even if its registered.

ATF to Issue Guidance on Stabilizing Braces

Your FPC team is in receipt of a draft notice from the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) regarding how the agency will be evaluating weapons with stabilizing braces. Based upon our initial review of this notice, we offer these thoughts for your consideration:

 

1) The draft document does not appear to reflect a new ban on pistol braces or firearms with such devices. The ATF, evidently, is not indicating that the mere presence of a brace on a pistol automatically converts the firearm into one under the purview of the National Firearms Act (NFA). (Indeed, the ATF has no authority to declare accessories like pistol braces to be NFA components, though the agencys previous conduct provides little reassurance.)

 

2) The draft document instead purports to be intended to inform the public on how brace-equipped firearms will be examined in the future. Based on the criteria set forth in the draft document, it appears that the ATF would take something of a totality of the circumstances approach in determining whether a specific brace-equipped pistol is a short-barreled firearm regulated under the NFA. These criteria include: the firearms type, caliber, weight, and length, the design of the brace itself, whether the firearm can be properly aimed when using the attachment as a brace, and whether an optic that cannot properly be used one-handed is present (i.e., something that suggests intent). The agency also indicates that it will observe the marketing of firearms and accessories, as well as other more subjective factors.

 

3) Importantly, the draft document recognizes that most people with braced firearms have acted in good faith. It suggests that the agency seeks to establish a procedure by which people who already have firearms that may fall under the purview of the NFA, and who wish to take advantage of registering them as NFA firearms to obtain the legal protections of such, may potentially do so without payment of the associated tax.

 

With that said, the policies in the draft document do not appear to be a significant departure from previous publicly undisclosed agency policies, some of which were discovered through criminal prosecutions, FOIA requests, and other sources. Your FPC team will be monitoring the situation closely. If anything changes we will let you know as soon as possible....

What is all this silly talk of "IF" Biden takes office as POTUS. It isn't an 'if' it's a 'when' and 'when' is Jan 20, 2021 at Noon. Unless some are psychic and see Kamala being sworn in instead? Heaven forfend.

 

In 4 years hopefully the Republicans can cull a few 'worthy' candidates out of the masses of schlubs in their ranks. I would gladly wager a buck it won't be the former President Donald Trump whose name is put forth. Four years of his petulant thumbs on the Twitter keyboard have all but guaranteed that.

The Bureau of Alcohol, Tobacco, Firearms, and Explosives (“ATF”) is publishing the objective factors it considers when evaluating firearms with an attached stabilizing brace to determine whether they are considered firearms under the National Firearms Act (“NFA”) and/or the Gun Control Act (“GCA”). ATF publishes this notice to inform and invite comment from the industry and public on the proposed guidance, Objective Factors for Classifying Weapons with “Stabilizing Braces,” prior to issuing a final document. Upon issuance of final guidance, ATF will provide additional information to aid persons and companies in complying with Federal laws and regulations. This notice also outlines ATF's enforcement priorities regarding persons who, prior to publication of this notice, made or acquired, in good faith, firearms equipped with a stabilized brace. Finally, this notice previews ATF's and the Department of Justice's plan to subsequently implement a separate process for current possessors of stabilizer-equipped firearms to choose to register such firearms in compliance with the NFA, including an expedited application process and the retroactive exemption of such firearms from the collection of NFA taxes.
