Foid denial mental health prohibitor

He checked the box saying you're a danger to yourself or others, yet did not have you involuntarily admitted to a psych ward? Shrinks are (supposedly) logical people, so I'd like to pose this question to the shrink: "If I'm such a danger to others, or even myself, then why are you gonna let me walk out this door without a pair of handcuffs on and an armed man escorting me out?"

Wasnt sure if there was a missing period in that sentence. Is he perhaps saying the mental health thing was over 5 yrs ago and his FOID was denied so he went to get form signed saying he was not a danger and sent that as appeal. Edited by InterestedBystander

Ah, apologies I read fast and miss stuff every now and then. Over five years ago. Unless you were admitted to a psych ward then I'd truly wonder about that doc's ideology. Shrinks are notoriously anti-gun, so even finding one who's willing to do an objective evaluation and certify that you are mentally firm is gonna be a bit of trouble. Either way, looks like you're going shrink shopping. Alternatively, as InterestedBystander suggested, go to your original doc and have him sign off, since he (or she) is the most qualified individual to make that call. Making the huge assumption that it'll be objective and not "How can I infringe on this guy's civil rights...again?"

I think he means he applied for a FOID card but was denied because he had a mental disqualifier more than 5 years ago. In that case, the applicant must undergo a mental health evaluation and the psychiatrist must send in the required form and letter to the ISP. The poster is wondering if that process starts the appeal process.

 

The appeal process does not begin until all the other forms are submitted as well.

That's why I would never see a mental health provider.

And this is why system has to be fixed. People need to be able to get their health in order w/o fear of loosing their rights.

There was a incident where a police report was made and that's how the ISP knows about a mental health issue? Or did you tell them about a event?

Mental health providers in Illinois are required to report their patients to the ISP.

 

Only when the practitioner believes the person to be a CLEAR AND IMMEDIATE DANGER to himself and/or to others. In the OP's case, the guy must have thought him to be a threat, and was obligated to report him.

 

Fearing similar issues, I scoured the DHS' website for every bit of information I could find. They only have to report it when they believe you to be a CLEAR AND IMMEDIATE DANGER, or mental handicapped. It would not apply to people that visit psychologists/psychiatrists, even if they are diagnosed and taking prescription medications. Outpatient self-care (visiting a shrink every once in a while, living independently, and self-administering prescription medication) is not considered "treatment" (as referenced in the application), according to what I read.

 

I could have misinterpreted it though, so I encourage you to read through it yourself. I am not a lawyer, nor do I have any experience with anything that would qualify me as any form of a professional in this area.
