Legislative Update 5/1/2016 The Legislature was not in session last week but, before they adjourned, we saw some late night shenanigans in the Senate with adoption of an amendment on SB3076 IEMA Police Powers. This is the bill that would establish intrusive police powers within County Government, including access to gun ownership and licensing data. With your help, progress on SB3076 was slowed but those late night maneuvers and a deadline extended a second time brought it to the brink of a final action vote. This bill will remain a threat at least until May 13, 2016 - longer if the deadline is extended further. Last week also saw the beginnings of a new push for Dealer Licensing in Illinois. Though still shrouded in secrecy, one element is expected to be a requirement for employee background checks. The anti-gun folks like to ignore the fact that firearm dealers are heavily regulated by the Federal Government now. In depth background checks are required of each applicant for a Federal Firearms License, and dealers are subject to regular audits. Licenses are routinely revoked when violations are found. Beyond this, Illinois requires any resident in possession of a firearm to maintain a currently valid Firearm Owners Identification (FOID) Card. Obtaining this card requires another layer of background checks for gun store owners and employees alike. Once issued, the State then verifies daily the eligibility of every FOID Card holder, and new laws and procedures are being implemented to allow the more efficient retrieval of cards that have been revoked. These truths, however, are hidden from the public because the real purpose of bills we've seen is to control and limit the number of firearm transfers currently legal under Illinois law, while eliminating private transfers through fees and red tape. The possibility of permanently closing gun shops innocent of any wrong doing is their hidden bonus. On a positive note, your efforts helped stall HB3160 Lethal Violence Order Protect. Though bills never die completely, HB3160 is safely tucked away in the Rules Committee, at least for now. HB5714 Crim Cd Armed Habitual Crim, a bill that in some ways could provide real solutions to Chicago's problems with violence, joins HB3160 in the Rules Committee awaiting the day its sponsor will work with opponents who fear its potential for undesirable consequences. And, in a departure for Illinois, SB2294 Crim Cd Switchblade Knife passed out of the Senate, hopefully to be consider by the House in the near future.
