Assault/battery this morning at the Lake Red Line station. Think I came out ok for 3v1, may post details in another thread. Both the male & female EMTs recommended CCW separately, then the ER nurse who checked me out did the same.

 

Anyone have an attorney recommendation? If nothing else I'd like to see the surveillance videos.

Well, isn't that a surprise! Unable to carry a weapon on the CTA, someone eventually gets attacked by multiple assailants, and the emergency responders and treating medical personnel suggest that the victim carry a concealed firearm. Oh, the irony!

Forgive me if this makes me sound like a jerk, but I'm happy that we might now have a test case. And I honestly mean that. I rely almost exclusively on public transit, and also spend a lot of time around Lakeview because that's where my friends live. With the spike in crime in that area, it's upsetting that I couldn't carry if I had my license because of having to take public transit.

 

Plus the mean-spirited side of me would love watching the yuppies freak out if concealed carry was legalized on public transit.

I'm more than willing to be a test case, just don't know of anyone specifically working this case. I sent an email to the ISRA last week but haven't heard back, and I've also sent a message through the NRA website. If anyone has Todd Vandermyde's contact info, or another recommendation, I'd much appreciate it.

Read Valinda's private massages, I'm sure she will help you find whatever you need. There's also the Second Amendment Foundation, they were a part of McDonald, so if you're a member maybe they're worth contacting as well. They do have free legal referrals for members.

And this case ought to be a winner. I can't see the chicken littles being able to successfully argue against carrying on transit with so much evidence of assaults and beatings. I hope we can finally have a test case. It would at least make something positive out of this crime committed against you.

Police warn of armed robberies at bus stops in South Shore

CHICAGO (STMW) - At least two people were robbed at gunpoint at CTA bus stops in the South Shore neighborhood last month.

In both incidents, one to three males walked up to a victim waiting at a bus stop, pulled out a firearm, and demanded property, according to a community alert from Chicago Police.

Both robberies happened Dec. 28, one at 5:12 a.m. in the 2000 block of East 79th Street; and the other about 12:45 p.m. in the 3000 block of East 79th Street, police said.

The robbers are described only as young males. Anyone with information should call Area South detectives at (312) 747-8273.

One classification I overlooked in 2013 was “Sex Offense” because I thought it was covered under Sexual Assault. Sex offense is a difficult category to parse because it includes public indecency as well as criminal sex abuse. I'm including only the serious offense of attempted criminal sexual abuse, criminal sexual abuse and aggravated criminal sexual abuse.

 

28 cases of criminal sexual abuse attempted or committed at CTA locations in 2014.

 

26 cases of criminal sexual abuse.

Note that the stats in the ABC article specify "on trains and buses". Platforms (where mine happened), ticketing stations, parking lots, etc aren't included.

One of the problems with trying to quantify CTA crime is that the crime must take place on or in actual CTA property for it to be assigned the "CTA" location code in the Chicago crime portal.

So if someone is accosted on the sidewalk outside of a CTA station, or 10 feet from a CTA bus stop - the location is not noted as "CTA nnn", the location is noted as "SIDEWALK".
Also, many parking facilities, while they are right next to the CTA and used almost exclusively by CTA patrons, are not actually part of the CTA. Even some parking facilities which say "CTA Parking" might not be CTA property, I'm assuming the CTA has entered into some revenue sharing scheme with the property owners or something. So if a person is victimized in a CTA parking lot - the crime might not have "CTA" as the location code, it will have the street address of the parking facility.
Even though its not perfect, the data paints a horrible picture of victimization in on the CTA

In 2014 the Chicago Data Portal began tracking a new type of crime called "CONCEALED CARRY LICENSE VIOLATION". There are three subcategories:

 

1) Armed while under the influence

2) Prohibited Places

3) Other

 

An interesting statistic for the CTA is that for all of 2015, there was one arrest made for CONCEALED CARRY LICENSE VIOLATION - Prohibited Places, however there were 21 cases of "WEAPONS VIOLATION." Twelve cases of "UNLAWFUL POSS OF HANDGUN", 1 case of "UNLAWFUL POSS OTHER FIREARM", 8 cases of "UNLAWFUL USE OTHER DANG WEAPON"

So...they're saying one is not the other if the person does not possess a concealed carry license?

 

I wonder what the details of that one concealed carry license violation. Can we FOIA those details?

The numbers that they came up with for robberies and criminal sexual assault are close to the numbers I came up with. The numbers can change over time as charges are dropped or upgraded / downgraded. Their numbers for assault and battery are different from mine since I left out "domestic" My reasoning for leaving out domestic assault or battery is that an argument could be made that robbery and general assaults are a threat to all commuters, any and all commuters could be targeted by it while a domestic violence isn't a general threat to the average commuter. I don't think that an assault on an estranged spouse is considered domestic violence - I think that's straight assault or battery. Domestic violence that happens on CTA property could just as easily happen at the parties residence. I don't think these are cases where a person has gotten a protective order from a spouse which is violated on CTA property, although the way the mayor juggles these statistics it is possible.

 

I also think the inclusion of burglary and arson in the article is a moot point for the average commuter. Burglary can refer to thieves breaking into CTA facilities to steal CTA property, it can also refer to thieves breaking into a car on CTA property - but there is no way to differentiate the cases using the Chicago Data portal. Arson could be any arsonist setting a fire on CTA property anywhere. The worst scenario would be an arsonist setting a fire inside a train or bus with passengers in it (I've never heard of an instance of this in news reports), but there is no way to differentiate the cases using the Chicago Data portal.
