How to Appeal Revoked or Denied FOID

My FOID Card and CCL were revoked due to a fraudulent EOP on 10/21/2019. Judge let the EOP expire 23 days later (November 2019).

Faxed and send by certified mail all paperwork: 03/18/2020.

FOID Reinstated: 06/21/2020 (Praise The Lord) thanks to Molly. Divorce is still in progress (or lack there of), spouse trying to file Red Flag Law. No mental history of any kind. My legal council had to send a Cease and Desist Letter to opposing legal council.

Still have not received a single firearm or ammunition from my life long firearms collection (many of the firearms and ammunition are premarital property marital) stored at the marital home, since being escorted out of our marital home on 10/22/2019; by a ******* County Sheriffs Deputy!

CCL Still Revoked with no option to appeal.

No criminal history of any kind!

Obviously, going on 6 months waiting to get some kind of response concerning for the CCL.

 

 

WHY IS YOUR CCL REVOKED WITH NO OPTION OF APPEAL??

 

Currently, CCL has been in Revoked status since the EOP of 10/22/2019.

Was extremely fortunate to have Molly help me finally get my FOID Card back in September 2020, Praise The Lord!

 

However, I have not been so fortunate with the CCL. I had sent all the required forms and paperwork, at the same time (March 2020), that I sent the same, that I did for my FOID Card. Never received any response of any kind. So, by June Molly had me try completing and providing some additional forms. Still, no response of any kind in late September, 2020. As a result, I called and left a voicemail on September 25th, 2020.

 

Finally, received an email requesting additional information, that I was under the impression that ISP already had in hand. Faxed copies and certified mailed documents on September 26th, 2020. The email stated they required the documents, in order to finalize my process.

 

Still, as of today, shows revoked and haven’t heard or received anything. As a result, I left another voicemail yesterday (October 8th, 2020) I always try to provide them with everything they request; within a 24 hour timeframe.

 

I pray to have this process completed and reinstated prior to POTUS election!

 

Bottom line for my wording, is that, after my mailing of my original information in March 2020, if it wasn’t for Molly, I would still have been waiting to hear or receive something from ISP, concerning what was required to reinstate my CCL and ISP would also still be waiting on me. I never received anything (USPS or email) letting me know that additional information was required! Also, no new information listed on the ISP FB Page, since the original Revoke Status that goes back to the beginning of this mess!

I'm in the boat with alot of you guys. Have a felony from about 12 years ago. Got my foid denied in 2015. Sent appeal in 2015. Spoke to a guy in 2017 who said my appeal looks pretty cut and dry amd should be approved no problem, but theres mo time frame on when someone will look at it, yet here it is 5 years later and still nothing. Only response I get is still available under review. I mean, I have emailed, called, left messages by the dozens, no response. Not sure where to even go from here. Do I need to talk to lawyer, or just sit on my hands?

I suggest you submit a request for a hearing to the ISP director:

 

Please keep me posted on your progress.

 

Sec. 10. Appeal to director; hearing; relief from firearm prohibitions.

  1. Whenever an application for a Firearm Owner's Identification Card is denied, whenever the Department fails to act on an application within 30 days of its receipt, or whenever such a Card is revoked or seized as provided for in Section 8 of this Act, the aggrieved party may appeal to the Director of State Police for a hearing upon such denial, revocation or seizure,

You will need to send a letter to the director and request a hearing on the appeal you filed on _____________ and give the date or approximate date you submitted your appeal. In the letter, give your full legal name, date of birth, FOID number, and the date your FOID card was denied/revoked. Send a complete set of the appeal forms you already filed.

 

If you are granted a hearing, which is usually a meeting with an administrative judge appointed by the ISP, you may be able to do that as a teleconference or may need to travel to Springfield. You can have an attorney with you, if you think you need one.

 

Send this all via a mail service that will provide you with a signed receipt of delivery to:

What are the options if after you send in this request, they ignore it.

 

 

It will be thirty Days on November 9, 2020 since I wrote Director Kelly demanding an Appeal.

 

Who has experience in filing with the circuit court to obtain my CCL license back?

 

I will not be hiring an Attorney, I am getting quotes close to $1000 , if the matter is resolved in one or two appearances.

Then I filed the recommended OP dismissed letter with the Court Order (cost $30):

 

NOTHING HAPPENED

 

 

I have tried calling more times than Judus asked for forgiveness.

 

 

Today I sent the complete Court Package of 18 pages by FAX ($14) and by Certified mail ($15) to Formally request a CCL Appeal DECISION by Brandan Kelly

I sent all of the paperwork for an appeal, but I have a few questions



First, my FOID was denied due to an voluntary admission to a mental health stay. The admission was more than five years ago. Received the psych examination that was 04/13/2020 sent in same day certifed.



Second, I I've called and emailed ISP Firearms Bureau regarding the status of the appeal was told by one rep in July that it was under review. Called back in sept to be told that it hasn't been processed at all, appeals dept still has not replied . How can I go about getting my FOID ? I was thinking of sending in an hearing letter

I am interested in seeing if a FOID court petition could be adapted for this. Might be a day or two before I can check into it.

 

I am also following. Because, as mentioned before, my CCL seems to be hung-up on something and I have not received or heard anything on its status.

I renewed FOID, and have it in hand, and several weeks ago I filled out the form that came with the revoke notice to have my CCL reviewed and hopefully reinstated. Two questions:

 

1 - is there anywhere to check on the status of this request? Website just shows revoked, and there's no sense of what happens procedurally for this to actually complete.

2 - there was no mention on the form about returning my revoked CCL with the form, although reading here it seems that may also be required. If so, is the other form dead-in-the-water and how can I go about refiling appropriately.

MY CCL IS ACTIVE NOW BUT THE CCL LICENSE WAS TAKEN BY THE LOCAL POLICE AND THUS I CAN NOT CARRY

IN MY CASE , THE LOCAL POLICE TOOK MY FOID, CCL, FIREARM AND AMMO. I HAVE AN ACTIVE CCL BUT NO LICENSE.

Did you know the police will now get a warrant and take yours guns from your home if you don't voluntarily take them in?

 

And they can do this with you never knowing an OP was filed against you.

 

The Sergeant told me this is policy now.

 

I'm pretty sure Molly will have much better answers then me.

I was just wondering if once you had a valid FOID in hand, did you get your guns back?

As for concealed carrying you will need a physical CCL.

Since you are Active and the ISP has it, why haven't they returned it?

 

I CANT TELL YOU WHO HAS MY PHYSICAL CCL, THE LOCAL POLICE TOOK IT, AND IT DISSAPEARED INTO A BLACK HOLE CALLED SPRINGFIELD

This is a generic petition based on other petitions we have seen - specific details from each individual case would need to be added and your attorney would need to to fill in the details about when the FOID was restored and how long it has been with CCL not restored. . .

Unfortunately, these types of appeals seem to be taking about 6 mos. to a year. Requesting an Administrative hearing might move things but might not.

Welcome to the club.I also did an appeal in 2017. All I received was a bill for $1000.00 for my "professional" evaluation.It is said to take 6 months to a year. "REALLY ?" Say hello to Jabba for me. Alias "TUB O GUTS

Thank you, Molly - much appreciated. I faxed the form to them about 5 weeks ago (I know that's no time compared to what others are experiencing). Is it likely that it would turn to 'appeal under review' on the website any time soon? What's the typical lag from receipt to the start of the review process?

I would hope your CCL status would change to appeal under review within 30 days or so of the appeal being filed. . . .

 

Thanks, again - it's been about twice that now - if I call the ISP number on the application/registration site would they have visibility to its status?

Or is that a completely different set of people/processes?
