Here are my observations on the amendment:

 

 

Senate amendment

 

* weapons must be concealed at all times. This creates a violation of the law if someone flashes a gun while reaching for a wallet, or takes their coat off while driving.

* the bill is MAY issue across the board. While it talks about the department shall issue, only IF all the criteria are met, which in cludes moral character and have a purpose.

* expands duty to inform to people who may not be law enforcement.

* fees are used to butress FOID and pay for the new LEADS system. $5 goes into mental health reporting.

*additional $25 for Chicago or Cook County endorsement Revenue stream for chicago and cook county

* 180 days before implimentation

* Notice will be sent to every applicants chief of police and sheriff where the applicant resides

* appeals process not spelled out, very limited; no award of costs or fees

* Chicago & Cook would be allowed to set up their own rules for carry under their endorsements

* no timeline for Chicago or Cook to respond

* no reciprocity or recognition of other states permits

* no allowance for non-residents to apply

* New prohibitions appear to come from chicago cfp and seeks to add aditional prohibitions like an weapons charge or misdemeanor from a bar fight.

* uses arrests without conviction for denail/prohibition

* requires proper reason to get a permit

* uses moral character guage in order to get a permit

* drug test failure grounds for denial- even for prescribed drugs

* misdemeanor for any weapons charge including hunting violations reason for denial

* application looks more like a entrance app to the CIA than a carry permit

* wavier of rights and consent to search

* expanded duty to inform

* requires finger prints and additional fees raising permit fee to $150

* unlimited rules and discreation for Chicago and Cook County for background checks

* no penalties for chicago or cookmkeeping their own list of permit holders

* $100 renewal fee $50 lost or destroyed

* most prohibited places include adjecent property

* mcpier and museums off limits

* no resteraunt carry

* no carry on mass transit

* no carry NEAR any school

* expanded college ban

* any building owner can enforce a ban on any one with a lease. Commercial or residential. This would include bans in common areas of condos or apartment buildings and malls

* The department can restrict permitees to time place and manner of carry

* limits on the types of handguns a person can carry

* increased penalties from hb997 class a first offense

* arrests trigger presumption of objection

* training must have been within 1 year of the bill taking effect. Knocks out most previous training

* courses must approved by state police

* training will be an illinois specific course due to required inclusions

* must train and qualify on any hamdgun a perspn wishes to carry

* tries to micro manage insteictors

* weak preemption language

 

* Adds background check language that would ban the transfers without state police check or loans of firearms to a friend while hunting or on a range

* adds language on prohibiting possesion of firearms and foid revocation based upon psycholgist or physician

* revocation of foid/ rights for failure to rort property crime

* inserts developmental disabilities as reson for foid revocation

* allows any person to report individuals for foid revocation

* colleges to report students for foid revocation

* ads no contact orders for foid revocation

Clearly that all meets the "reasonable restrictions" requirement in the 7th circuit's ruling....

 

Well, I guess if you know going into it that you are writing something that sucks then you might as well make it really suck....

I'm starting to think these clowns all have a pool going to see who can come up with the most ridiculous bill...

Yup exactly the kind of bill I would expect the Chicago machine would come up with.

 

And they think this follows the spirit of the 7th district courts ruling... How?

 

They just continue to live in that special privleged bubble. How much will this cost the taxpayers if this is passes? After the obvious lawsuits are settled?

Would have been easier to write, concealed carry in Illinois is allowed but not by individual residents of the state or by non residents passing through the state. Retired and active duty on leave law enforcement exempt from exclusions(they asked for assistance from Acevedo).
