I am attaching a fact sheet of Quinn’s assault weapon ban. Thought you might be interested in reading it. This is one piece of legislation that may or may not (according to Quinn’s office) be discussed this Friday. I will have you know that Brad is totally against this bill. He believes we have too many gun laws as it is now. It is not fair that law abiding citizens are punished in light of tragedies such as that in Aurora, Colorado. We should mourn for the losses, but it should allow us more gun rights so we can prevent these instances in the future. Brad was wanting to stop by xxxxxxxxxxxxxx sometime in the near future. Would he be able to meet with you when he is there? Hope that your day is going good.

URT SB 681 AV (Luechtefeld/Costello) Assault Weapon Ban

 

The Governor amendatorily vetoed SB 681. The AV language is modeled after HB 1294/SB 1588 (Acevedo/Munoz) and prohibits the manufacture, possession, delivery, sale and purchase of semi-automatic assault weapons, assault weapon attachments, .50 caliber rifles, and .50 caliber cartridges. The AV also increases the penalty for crimes associated with these weapons.

  • Weapons Prohibited
    • Generally, the prohibition covers semi-automatic assault weapons and their attachments. This includes weapons with a folding/telescoping stock, a thumbhole stock, a shroud covering the barrel, and a fixed magazine capable of accepting more than 10 rounds of ammunition.
    • The AV specifically lists certain weapons meeting the definition of semi-automatic assault weapons, such as Avtomat Kalashnikovs (all models, including the AK-47), the UZI, the Colt AR-15 (used in the recent Colorado movie theater shooting) and the TEC-9. The bill also bans the possession of shotguns with ammunition in a revolving cylinder.

    [*]Sentencing

    • The AV makes it a Class 3 Felony (Class 2 for second offense) for possession of a semi-automatic assault weapon or a .50 caliber rifle.
    • The AV makes it a Class 4 Felony (Class 3 for second offense) for possession of a semi-automatic assault weapon attachment and a Class A misdemeanor for possession of .50 caliber ammunition.

    [*]Exceptions

    • The prohibitions do not apply to peace officers, military personnel, corrections officers, professional shooting competitors, and those hunting as expressly permitted under the Wildlife Code.
    • The prohibitions do not apply to the manufacture of weapons or ammunition for members of the Armed Services or Reserve Forces.

    [*]Reasons for Support[1]

    • Currently, anyone with a FOID card in Illinois has the ability to purchase an assault weapon such as an AK-47 or AR-15 or a .50 caliber sniper rifle. [2]
    • Currently, Illinois does not impose any restrictions on the purchase or possession of large capacity ammunition magazines.
    • The AV language will not adversely affect hunting in Illinois, as it includes an exception for hunting use permitted under the Wildlife Code.[3] The AV language prohibits people from obtaining extremely dangerous weapons, not from hunting.
    • In the wake of the Aurora, Colorado shootings, the need to prevent an individual from stockpiling assault weapons and large ammunition magazines is increasingly apparent.
    • The assailant in the Colorado shooting purchased all of the rifles and ammunition used in the massacre legally.
    • In 1994, the federal Bureau of Alcohol, Tobacco, Firearms and Explosives characterized assault weapons as “mass produced mayhem” and weapons of choice for gangs, drug dealers, and mass killers to outgun polices officers on the streets.[4]
    • Since the federal assault weapons ban expired, police departments across the country have experienced an increased presence of these high-powered weapons on the streets.[5]
    • One-fifth of the law enforcement officers slain in the line of duty between January 1998 and December 2001 were killed with assault weapons.[6]
    • Eight in ten Illinois voters favor a law to ban assault weapons.[7] More people with firearms behavior (including voters who are gun owners, members of the NRA, hunters and/or FOID cardholders) strongly favor an assault weapons ban (44%) than strongly oppose it (31%).[8]
    • A November 2008 survey found that 65% of voters nationwide support banning military-style assault weapons. Of gun owners surveyed, 60% said that they would support such a ban.[9]
    • California, Connecticut, Massachusetts, New Jersey and New York ban assault weapons, and Hawaii and Maryland ban assault pistols. California is the only state to have banned .50 caliber sniper rifles. California, Hawaii, Maryland, Massachusetts, New Jersey, and New York have enacted laws banning large capacity ammunition magazines.[10]
    • The United States Supreme Court held that the scope of the Second Amendment right is not without limitations.[11] Certain types of weapons are not eligible for Second Amendment protection and the Court has long recognized firearm regulations prohibiting a category of “dangerous and unusual weapons”.[12]

They mention fixed magazines over 10 rounds, then specifically list AR-15's and AK-47's.

 

So which is it Governor? Oh, yeah, you wouldn't know the difference would you? Nor would any of your people writing this bill. If you're going to push for something, at least hire some folks that know what you're talking about!!

 

If ineptitude is a word, this Gov's full of it!!

You give them too much credit. They wouldn't know a Taurus Judge if it bit them. One of them's probably seen the youtube of the AA12. How many of them to you suppose they've picked up off the streets of Chicago? Or been used in a crime??

They're talking about this one...that you haven't been able to get in the US since 2001 (well, that's when registrations closed with the ATF, who knows when you couldn't import them anymore).

That was one of its nick names, I believe that name pertains to sawed off shotguns and the like. The original producer was a South African company, it was the Armsel Striker.

Street sweepers may be "tacticool" to some people, but after you empty that drum, it will probably take a good 4-5 minutes to reload it. Not what I would want in a defensive situation. No thanks, I'll take a pump Mossberg, or a Rem 870 over a "sweeper" anyway.

 

Nonetheless, if someone wants to purchase one, I believe they should be able to buy one if they so desire. Because it's the intent of the person that determines his actions, not what he's holding in his hands at any given time. Give it up, Gov. Quinn - you're not writing good law.

Just thinking; with the problems Illinois has, how sad is it that he is worried about crap like this? If he were competent he would be spending all of his time trying to get Illinois fixed.

 

Whatdayamean? He DID fix Illinois. Just like ya fix your dog.
