  3. Something to think about: state and county level judges have to stand for reelection, correct? One guesses that in a few counties letting these perps skate, when they could be held, might be a resume enhancer. In the rest of the state, probably not so much.

  7. They may not have taken into account the idea that lower court judges would openly flaunt the Supreme Court's rulings.
  8. Somebody should explain to them that the same Constitution that protects freedom of the press (them) protects the right to keep and bear arms (us).
  9. If the panel that heard the case originally voted 2-1 against us, then 3-0 against the en banc request....you can pretty much figure it.
  10. Free speech is for everybody, or it's safe for nobody. I'm sure I disagree with the ACLU as much as they disagree with the NRA. But props to them for representing the NRA (and therefore free speech) in this case.

  12. Yeah. How does Judge Easterbrook's test square with Bruen? Pretty sure it doesn't. Also pretty sure that (to be quite honest) the judge doesn't care.

  14. Justice Jackson's observation about the Founders' race and predominant religion doesn't exactly inspire confidence in her dedication to fair mindedness.

  16. "News" article doesn't say a word about the Bruen decision, or the Supreme Court period. Imagine that.
  17. Up front, apologies if this has been asked: Since the 9th is (or has been)giving SCOTUS precedent short shrift, is it possible for Miller to appeal directly to SCOTUS if the 9th agrees to hear this?
