Amends the Mental Health and Developmental Disabilities Code. In provisions concerning developmental disability and notice, makes changes to a definition. In provisions concerning clear and present danger and notice, makes changes to confidentiality regarding the identity of the person making the report and limits liability for the disclosure or nondisclosure of certain information. Amends the Firearm Owners Identification Card Act. Defines "collateral records", "Department of Financial and Professional Regulation-approved continuing education sponsor", "FOID reinstatement mental health evaluation", and "FOID reinstatement mental health evaluator". In provisions concerning grounds for denial and revocation, makes changes regarding revocation or denial based on a person's status as a patient in a mental health facility and adds provisions regarding a person who previously submitted an affidavit or written consent for another individual to obtain a Firearm Owner's Identification Card if the person is later convicted of, or pleads guilty to, conduct demonstrating that the person knew or should have known it was unreasonable to provide such consent. Makes conforming changes to the Mental Health and Developmental Disabilities Confidentiality Act. Makes technical changes.

In the definition of "FOID reinstatement mental health evaluation", adds a definitional requirement of no more than one office visit conducted by telehealth means, subject to the professional discretion of the FOID reinstatement mental health evaluator conducting the FOID reinstatement mental health evaluation. Makes changes to the definition of "FOID reinstatement mental health evaluator", including concerning definitional requirements for training and continuing education. Makes changes to a ground for denial and revocation of a Firearm Owner's Identification Card concerning mental health. Amends the Criminal Identification Act to add information the clerk of the circuit court of each county shall furnish the Illinois State Police. Amends the Mental Health and Developmental Disabilities Code. In provisions requiring specified medical and mental health professionals to notify the Department of Human Services whenever they determine a person who is under their professional care poses a clear and present danger to himself or herself, provides that the identity of the reporter shall not be disclosed to the subject of the report unless ordered by the Firearm Owner's Identification Card Review Board or a court with appropriate jurisdiction in accordance with the Firearm Owners Identification Card Act. Provides that the Department of Human Services and its employees or agents shall not be held liable for damages in any civil action arising from the disclosure or nondisclosure of the information released in accordance with the Firearm Owners Identification Card Act. Adds similar provisions to the Mental Health and Developmental Disabilities Confidentiality Act.

	<span style="font-size:16px;"><font face="Arial, sans-serif"><font face="Arial, sans-serif">HB4471 was the subject of our <a href="https://illinoiscarry.com/forum/index.php?/topic/85107-call-to-action-3222026-witness-slips-needed/" rel="">March 22 Call to Action</a> because it is designed to either force gun manufacturers to either adopt inferior, less safe designs or to completely ban those manufacturers. Though the bill does not mention Glock by name, it was made clear in committee testimony that the target is Glock, including Glock's new design meant to address the complaints of anti-gun forces. Glock clones would naturally be included.</font></font></span>

The bill proposes to </font></font><font color="#000000"><font face="Arial, sans-serif">deny those accused of being a clear and present danger by medical personnel their most fundamental right to confront their accuser, by concealing the identity of the accuser. Again, we oppose.</font></font></font></span>

	<span style="font-size:16px;"><font face="Arial, sans-serif">A third bill, <a href="https://ilga.gov/Legislation/BillStatus?DocTypeID=HB&amp;DocNum=5209&amp;GAID=18&amp;SessionID=114&amp;LegID=166867" rel="external nofollow">HB5209 FOID – Mental Health</a>, is new to our calls to action but not new to the state's attacks on rural Illinois and minorities. In the <a href="https://ilga.gov/Legislation/BillStatus/FullText?LegDocId=211073&amp;DocName=10400HB5209ham002&amp;DocNum=5209&amp;DocTypeID=HB&amp;LegID=166867&amp;GAID=18&amp;SessionID=114&amp;SpecSess=&amp;Session=" rel="external nofollow">most recent amendment</a> filed, it creates even more roadblocks to restoration of rights than currently exist, by requiring at least 2 office visits to a “FOID reinstatement mental health evaluator” – a qualification that does not currently exist and is unlikely to ever commonly exist. </font></span>

Replaces that provision with a provision that states that the Act does not apply to or affect qualified law enforcement officers and qualified retired law enforcement officers, as defined in the Law Enforcement Officers Safety Act of 2004, and as recognized under Illinois law. Deletes the amendatory changes to the Illinois Administrative Procedure Act.

	 Replaces everything after the enacting clause. Creates the Responsibility in Firearm Legislation Act. Establishes the Responsibility in Firearm Legislation Licensing Program. Provides that the Department of Financial and Professional Regulation shall develop and administer the RIFL Licensing Program in which a manufacturer shall be issued a license upon payment of a fee set by the Department. Provides that the fee shall correlate with its responsible portion, based on experience rating, of the total annual aggregate fee. Requires the Department to contract with an actuarial or economics consulting firm to determine manufacturers' responsible portions in the first year of the program. Sets the total annual aggregate fee to $50,000,000 for the first year and between 7% and 15% of costs resulting from firearm deaths and injuries for subsequent years. Requires no more than 10% of the annual aggregate fee to be appropriated for personnel, administration, and other costs of the Department, except that it may be adjusted in the first year or any year the Department contracts with an actuarial or economics consulting firm. Prohibits manufacturers from operating without a license, retailers, importers, or distributors from selling, importing, or distributing, respectively, firearms from an unlicensed manufacturer, and a licensed dealer, private seller, sponsor of a firearm trade show, or organizer of a firearm trade show from selling, distributing, sponsoring, or organizing to effectuate the selling of firearms from an unlicensed manufacturer. Creates the Responsibility in Firearm Legislation Fund as a special fund in the State treasury. Requires all law enforcement agencies to report specified information from recovered firearms to the Illinois State Police, and requires the Illinois State Police to provide a compiled report to the Department. Provides for enforcement by a State's Attorney or the Attorney General. Provides for a civil penalty of up to $250,000 for an unlicensed manufacturer operating in the State, and up to $10,000 for specified other violations. Specifies that a manufacturer that operates in the State but then stops operating and paying fees for any period of time but then later resumes operating in the State must pay all the fees for the years the manufacturer was not operating and not paying its annual fees. Adds to the ability to recover fees and penalties from a successor in interest under the Act. Sets specified dates for specified provisions. Makes findings and declares the purpose of the Act. Provides that beginning June 1, 2027, all law enforcement agencies shall report to the Illinois State Police any firearms identified by physical recovery or through tracing that resulted in a firearm injury or firearm death, and shall include the manufacturer, and if available the serial number, make, or model of the firearm. Provides that beginning June 19, 2028, a licensed dealer, pawnbroker, private seller, sponsor of a firearm trade show, or organizer of a firearm trade show may not sell, distribute, sponsor, or organize to effectuate the selling of firearms in this State from a manufacturer who does not have a license issued by the Department under the Act. Defines terms. Requires the Department to adopt rules. Makes conforming changes to the State Finance Act.
