Updates:

SB114 passed the House as amended (HA1 & HA2).

The Senate concurs with HA1 & HA2 and the bill has passed both houses, as amended.

The Governor signed SB114 into law on 12/6/2013. It is now Public Act 98-0600.

When the legislature last met, SB0853 - Safety Tech (Youth Hunting) passed in the House and now awaits the governor's signature. SB1342 - Mandatory Minimum Sentences, though eligible for a vote based upon amendments filed earlier in the year, was held at second reading due to notes pending on amendments filed at the last minute. The deadline for this bill has been extended to 12/20/2013, with the needed notes projecting a cost of more than $0.5 Billion.

Yesterday in committee, House Amendment 2 to SB114 was approved for consideration as a trailer bill to the Firearm Concealed Carry Act.



The House and Senate are scheduled for 11:00 AM.

House Amendment 3 to SB1342

Replaces everything after the enacting clause. Amends the Criminal Code of 2012. Enhances the penalties for certain violations of the statutes concerning unlawful use or possession of weapons by felons, aggravated unlawful use of a weapon, and unlawful possession of a firearm by a street gang member. Amends the Unified Code of Corrections. Provides that a prisoner serving a sentence for unlawful use or possession of a weapon by felons, aggravated unlawful use of a weapon, or unlawful possession of a firearm by a street gang member shall receive no more than 4.5 days of sentence credit for each month of his or her sentence of imprisonment. Provides that a person convicted of unlawful use or possession of weapons by felons or persons in the custody of the Department of Corrections facilities or unlawful possession of a firearm by a street gang member is ineligible for the county impact incarceration program.

The total impact of SB 1342 (H-AM 3) would be an increase of 2,993 inmates. It would add additional operating costs and construction costs of $713,433,100.00 over ten years.

Senator Forby introduces House Amendment to SB114 - describes it as a simple clean up bill. Speaks to the several issues covered.

Among other explanation, corrections officers are exempt from training*, retired law enforcement is granted 8 hours grandfathered training.

Addresses issues with finger printing, out of state instructors.

Amend 3 was adopted in committee. I thought 4 and 5 had been approved for consideration but I'm not seeing that now.


ETA Amend 5 was approved and 4 is in limbo. It could be voted on with 3 or 5 but I'm not sure what the Black Caucus' position is now.

In response to Rep Sullivan's question, Phelps confirms that the state, and only the state, has authority to regulate carry.

The City of Chicago cannot pass ordinances requiring restaurants or other private property owners to post no carry signs.

Quick, but well worth listening to legislative intent in regard to preemption regarding carry of firearms. Go to about 1:07:00 here.


To paraphrase, in regard to preemption:

Phelps: The state and only the state can regulate how, where, when you carry.

Sullivan: Chicago recently passed a ban requiring restaurant owners to prohibit carry. Did something in the law change to allow that?

Phelps: The city cannot add additional places that a person cannot carry a concealed firearm, nor place additional mandates or requirements on licenses. They cannot mandate that all private property post no carry signs. What they did was a backdoor ban of concealed carry. The law we passed does not allow them to do that or any other home rule ordinance.

Sullivan: So when the city's ordinance is challenged in court, when the court looks to legislative intent, is it our intent, the legislative intent, to prohibit this sort of threatening of their license?

Phelps: Absolutely. They cannot regulate how you carry, where you carry, what you carry, the type of ammunition you carry, how much ammunition you carry, the size or the magazine or the types of sights you use.
