Executive Summary

Pass an Ordinance establishing an assault weapons ban.

Discussion

The General Assembly passed the concealed carry law, HB 183 on June 5, 2013. If the

bill is signed into law in its current form, home rule communities will have 10 days from the

date the Governor signs it, to adopt an assault weapons ban if they wish. After that period,

HB 183 pre-empts home rule authority from adopting such a ban. Currently, Hanover Park

has no ordinance banning assault weapons.

Due to the fact that there is not a Village Board meeting scheduled for the first Thursday of

July, Mayor Craig has requested that the issue be included on the June 20, 2013 regular

Board agenda, in addition to the June 20, 2013 Workshop agenda, in case the Board

wishes to take action.

This item was on the June 20, 2013 Workshop agenda for discussion and direction.

No person shall manufacture, sell, offer or display for sale, give,

lend, transfer ownership of, acquire or possess any assault weapon

or large capacity magazine.

 

Any assault weapon or large capacity magazine possessed, sold or

transferred in violation of this Sec. 66-17.5 is hereby declared to be

contraband and shall be seized and disposed of in accordance with

the provisions of © Destruction of weapons confiscated, below.

 

Notwithstanding any other penalty provided for in this Section, any

person found in violation of this section shall be sentenced to not

more than six months imprisonment or fined not less than $500.00

and not more than $5,000.00, or both.

 

Any person who, prior to the effective date of the ordinance

codified in this section, was legally in possession of an assault

weapon or large capacity magazine prohibited by this section shall

have 90 days from the effective date of the ordinance to do any of

the following without being subject to prosecution hereunder:

Will be emailing model complaint this morning to all at the village. They best think long and hard before doing this.

Emailed complaint to Village attorney, who is from DeKalb. Strange. Still looking for other emails if anyone finds them. Even contact form for village does not allow attachments. May send them note that it was delivered to their attorney.

Probably my best chance to meet other IC members.

 

I am guessing this will go like Oswego - are there plans to go out afterward?

 

1. fingers crossed that it does go like the Oswego meeting.

 

2. if so, be prepaired to, and post here, a place to meet after... Figured I'd say hi to other IC'ers... but everyone was out the door as soon as "seeing none, the motion is tabled". I had to go home and log on to see where everyone was... and by then, the couch and kitty were very happy to see me.

You may not scare the Village Attorney by sending him/her the sample complaint. They may use it to propose an amendment to the ordinance to make your sample complaint moot. Also, Village Attorneys like this are private lawyers that get paid hourly, so a threat of litigation with high fees and hourly costs won't scare the very lawyer that would be tasked with defending the Ordinance and reap those many hours of fees. You need to scare the Trustees with the threat of litigation, not the lawyer that wants the billable hours the litigation would bring.

A couple years ago I was a Hanover Park resident and had traded some emails with the Village President, Rodney Craig. Here are the two email addresses he sent me mail from. I would email him at both addresses, but it seems he uses the comcast.net one more than the hanoverparkillinois.org on. Wouldn't surprise me if he wanted to keep emails off the village email and therefore out of the public record. rodney.craig@comcast.net and rcraig@hanoverparkillinois.org

ALL look at the working group packet. that meeting is scheduled for 6:00PM not 730 ! ! !

 

There are two parts to the packet. One part dealing with tonight's meeting at 7:30, a second part dealing with a workshop meeting on June 6 where the carry bill was discussed and that meeting was at 6 pm

 

I think the meeting tonight is at 7:30 - but get there early to get a seat!
