C0untZer0 Posted May 15, 2013 at 03:31 PM Posted May 15, 2013 at 03:31 PM It's actually called an "entertainment tax". They tack a 5% tax ($2.00) onto the cost of paying for a range session at Article II gun range. Categorizing range time as entertainment doesn't seem to jive with Ezell.
patriot1776 Posted May 15, 2013 at 03:49 PM Posted May 15, 2013 at 03:49 PM Many home rule towns and possibly others have this tax and yes it applies to gun ranges and other forms of entertainment.
BobPistol Posted May 15, 2013 at 03:50 PM Posted May 15, 2013 at 03:50 PM Taxing a constitutional right, eh?
Patriots & Tyrants Posted May 15, 2013 at 04:00 PM Posted May 15, 2013 at 04:00 PM Dundee does the same. I think GAT collects 2%
patriot1776 Posted May 15, 2013 at 04:07 PM Posted May 15, 2013 at 04:07 PM Taxing a constitutional right, eh? Well the SCOTUS said Obama care was a tax which they can't regulate ? Open the flood gates here come the taxes or at least open your wallets and write the checks.
patriot1776 Posted May 15, 2013 at 04:09 PM Posted May 15, 2013 at 04:09 PM The town of Plainfield ( Mega Sports ) has collected this tax since the first range opened.
lockman Posted May 15, 2013 at 04:23 PM Posted May 15, 2013 at 04:23 PM Dundee does the same. I think GAT collects 2% I don't think Greg will raise any issue with it, but I am sure GAT would welcome an outside challenge. The village of East Dundee certainly is counting on collecting the tax to offset the tax incentives given to GAT for the expansion.
C0untZer0 Posted May 15, 2013 at 04:25 PM Author Posted May 15, 2013 at 04:25 PM It would be easy for Chicago to make it a $25 surtax. Then Cook County charges a $5.00 entertainment surtax The state starts charging a $2.50 entertainment surtax... If I understand Ezell correctly, government banning of ranges is the equivalent of banning firearms - unconstitutional under McDonald. Taxing it to death is the next best thing, and we have the Kwong case at the federal level now being heard. These tiny entertainment taxes represent the camel's nose under the tent.

The village of East Dundee certainly is counting on collecting the tax to offset the tax incentives given to GAT for the expansion. I think so long as its a general "tax" on not just a GUN tax then I don't see it going very far in the courts.I am much more interested in seeing what happens with the lawsuit over Cook County's so called "Violence" tax.IMO that is pretty much a poll tax, applied only to firearms which violates the constitution. If they added a $25.00 flat tax on every item purchased in Cook County over $400.00 I bet they could get away with it but by singling out firearms or ammountion(right to keep and bear arms) they run on the wrong side of the constitution. Do any other states or localitie currently have a stated TAX on firearms? I am not talking about insane licence fees, permit fees, documentation fees, etc etc I mean a stated "tax" on firearms or ammunition at the state or local level?

Open the flood gates here come the taxes or at least open your wallets and write the checks. This is more truthful than most people realize. My fear is in the future you may be "taxed" or forced to buy insurance on everyday items like....jeans or a tv or whatever else. It's only a matter of time. Just watch as this tax/insurance scam snowballs into something ginormous!

The real truth is Obama is way short on cash for all the social programs he and the Democrats promised so taxes and increased fees are on the way.
lieut89 Posted May 15, 2013 at 11:36 PM Posted May 15, 2013 at 11:36 PM When range qualification becomes mandatory, where does entertainment come into play? Will we see a tax waiver for required range time?

Will we see a tax waiver for required range time? That makes a lot of sense. But that means less money for local government cronies, so it will never happen.
bob Posted May 16, 2013 at 11:59 AM Posted May 16, 2013 at 11:59 AM It seems like a more or less legit tax given it applies to other entertainment establishments as well. The first amendment does not prohibit sales taxes on books or real estate taxes on newspapers.
POAT54 Posted May 16, 2013 at 12:05 PM Posted May 16, 2013 at 12:05 PM Taxing a constitutional right, eh? YES, just because a pool tax was found unconstitutional, took years to stop that. Anti's figure we will have emptied all of our magazines, by then.
wilessiuc Posted May 16, 2013 at 12:12 PM Posted May 16, 2013 at 12:12 PM A pool tax? That will make my summers expensive!

C0untZer0 Posted May 16, 2013 at 01:14 PM Author Posted May 16, 2013 at 01:14 PM A pool tax may be an example of a legitimate entertainment tax.
BigJim Posted May 16, 2013 at 07:41 PM Posted May 16, 2013 at 07:41 PM How is range time entertainment? A movie is entertainment. A concert in entertainment. Range time is honing your skills so you can defend yourself and family.

I think you are going to have a hard time in court making the argument that most people out at the range are not having a good time. Just look at all the smiles on the faces of the people shooting.
Xwing Posted May 17, 2013 at 01:29 PM Posted May 17, 2013 at 01:29 PM This tax is not right. But I doubt it could be called Unconstitutional. Just one more way (out of millions) for the government to treat citizens poorly.
C0untZer0 Posted May 17, 2013 at 05:51 PM Author Posted May 17, 2013 at 05:51 PM The 2 cases that might be relevant are Kwong v Bloomberg and Ezell v Chicago.
